Covering the Work. No portion of the Work will be enclosed or covered until inspected by Buyer other than temporary covers as required to protect the Work. If the Work is covered prior to Buyer’s inspection, at the request of Buyer, the Contractor will uncover at Contractor’s expense for the purpose of Buyer’s inspection. Buyer may further inspect any Work that it suspects may not be in compliance with the requirement sof the Contract Documents. If such further inspection determines that the Work is in accordance with the Contract Documents,, Buyer will pay Contractor all reasonable costs incurred by Contractor for the purpose of the re-examination and recovering of the Work. If that Work is determined to be non-compliant with the requirements of the Contract Documents, the costs incurred by the Contractor for the purpose of the re-examination and re-covering of the Work will be at Contractor’s expense.

Covering the Work. Company may order inspection of questioned Work at any time, and if so ordered, the Contractor must uncover that Work. If that Work is in accordance with the Contract Documents, Company shall pay the cost of re-examination and recovering. If that Work is not in accordance with the Contract Documents, then Contractor shall remedy such nonconforming Work at Contractor’s expense.

If covered prior to inspection, at the request of Exelon, it shall be uncovered at Contractor’s expense. Inspection of questioned Work may be ordered by Exelon at any time; if so ordered, that Work must be uncovered by Contractor. If that Work is in accordance with this Agreement, Exelon shall pay the cost of re-examination and recovering. If that Work is not in accordance with this Agreement, then Contractor shall remedy such nonconforming Work at Contractor’s expense.

Related to Covering the Work

  • Continuing the Work The Contractor shall carry on the Work and adhere to the progress schedule during all disputes, disagreements or alternative resolution processes with the Owner. The Contractor shall not delay or postpone any Work because of the pending resolution of any disputes, disagreements or processes, except as the Owner and the Contractor may agree in writing.

  • Completion of the Work The Contractor must obtain Material Completion as defined in Section 6.1.2 below prior to any occupancy of the Project.

  • Marketing the Property In an effort to properly and efficiently market the Property, the Seller grants the following permissions to the Agency: (Initial ALL That Apply)

  • Execution of the Project (a) The Recipient declares its commitment to the objectives of the Project as set forth in Schedule 2 to this Agreement, and, to this end, shall carry out the Project through its MoE with due diligence and efficiency and in conformity with appropriate financial, economic, environmental and administrative practices, and shall provide, promptly as needed, the funds, facilities, services and other resources required for the Project. (b) Without limitation upon the provisions of paragraph (a) of this Section and except as the Recipient and the Association shall otherwise agree, the Recipient shall carry out the Project in accordance with the Implementation Program set forth in Schedule 4 to this Agreement. (a) Except as the Association shall otherwise agree, procurement of the goods, works and consultants’ services required for the Project and to be financed out of the proceeds of the Grant shall be governed by the provisions of Schedule 3 to this Agreement, as said provisions may be further elaborated in the Procurement Plan. (b) The Recipient shall update the Procurement Plan in accordance with terms of reference acceptable to the Association, and furnish such update to the Association not later than twelve (12) months after the date of the preceding Procurement Plan, for the Association’s approval. Section 3.03. Without limitation upon any of its obligations under paragraph (a) of Section 3.01 of this Agreement and except as the Recipient and the Association shall otherwise agree, the Recipient shall: (i) not later than by the effectiveness of this Agreement open a separate project account (the Project Account) in a commercial bank acceptable to the Association; (ii) thereafter maintain the Project Account during the entire Project implementation period, and replenish said Account regularly with funds sufficient to ensure the Recipient’s Project co-financing obligations; and (iii) use the amount in the Project Account exclusively for financing the Recipient’s contribution to Project expenditures. Section 3.04. For the purposes of Section 6.09 of the General Conditions and without limitation thereto, the Recipient shall: (a) prepare, on the basis of guidelines acceptable to the Association, and furnish to the Association not later than six (6) months after the Closing Date or such later date as may be agreed for this purpose between the Recipient and the Association, a plan designed to ensure the continued achievement of the Project’s objectives; and (b) afford the Association a reasonable opportunity to exchange views with the Recipient on said plan.

  • SCOPE OF THE WORK The Contractor shall furnish all the materials, perform all of the Work, and do all things required by the Contract Documents.

  • Testing-the-Waters Materials If at any time following the distribution of any Written Testing-the-Waters Communication there occurred or occurs an event or development as a result of which such Written Testing-the-Waters Communication included or would include an untrue statement of a material fact or omitted or would omit to state a material fact necessary in order to make the statements therein, in the light of the circumstances existing at that subsequent time, not misleading, the Company will promptly notify the Representatives and will promptly amend or supplement, at its own expense, such Written Testing-the-Waters Communication to eliminate or correct such untrue statement or omission.

  • Examination of work before covering up In respect of the work which the Authority’s Engineer is entitled to examine, inspect, measure and/or test before it is covered up or put out of view or any part of the work is placed thereon, the Contractor shall give notice to the Authority’s Engineer whenever any such work is ready and before it is covered up. The Authority’s Engineer shall then either carry out the examination, inspection or testing without unreasonable delay, or promptly give notice to the Contractor that the Authority’s Engineer does not require to do so. Provided, however, that if any work is of a continuous nature where it is not possible or prudent to keep it uncovered or incomplete, the Contractor shall notify the schedule of carrying out such work to give sufficient opportunity, not being less than 3 (three) business days’ notice, to the Authority’s Engineer to conduct its inspection, measurement or test while the work is continuing. Provided further that in the event the Contractor receives no response from the Authority’s Engineer within a period of 3 (three) business days from the date on which the Contractor’s notice hereunder is delivered to the Authority’s Engineer, the Contractor shall be entitled to assume that the Authority’s Engineer would not undertake the said inspection.

  • UNIT WORK When the Employer deems it necessary in order to carry out a mission and operations of the campus, the Employer may contract out work provided that the contracting out does not displace bargaining unit employees or reduces their scheduled hours. The Maine Community College shall notify MSEA-SEIU when contracting out is to be implemented. MSEA-SEIU may request to meet and confer on the impact on contracting out such work. The Maine Community College shall meet with MSEA-SEIU within thirty (30) days of such request. Notice to MSEA-SEIU shall be not later than one hundred twenty (120) days prior to the commencement of the contracting out. In emergency circumstances, when the College enters into a contract under which contracting out will commence in less than thirty (30) days, when possible, notification shall be made two (2) weeks prior to implementing the contract, but in no event later than ten (10) working days after the commencement of the contracting out. Prior to the meeting and conferring on contracting out, the Maine Community College System will provide MSEA-SEIU all relevant written information, including copies of bids received, any cost analysis used by the College to evaluate the need for contracting out, and all other relevant material used by the College in making its decision regarding contracting out. Contracting out of the type of work normally performed by existing bargaining unit members for limited periods not to exceed six (6) months shall be allowed without the Union’s agreement if one or more of the following conditions are present at the affected campus or other non-campus location (such as the System Office in Augusta): 1. The skills and abilities or legally required licenses or equipment needed to perform the work are not available within the bargaining unit. 2. The opportunity to do the work is declined by any qualified and available bargaining unit employees. “Qualified” as used in this Article is defined as having special skills, abilities, license or equipment necessary to perform the work.

  • ENDING THE TENANCY 1) The tenant may end a monthly, weekly or other periodic tenancy by giving the landlord at least one month's written notice. A notice given the day before the rent is due in a given month ends the tenancy at the end of the following month. [For example, if the tenant wants to move at the end of May, the tenant must make sure the landlord receives written notice on or before April 30th.] 2) This notice must be in writing and must a) include the address of the rental unit, b) include the date the tenancy is to end, c) be signed and dated by the tenant, and d) include the specific grounds for ending the tenancy, if the tenant is ending a tenancy because the landlord has breached a material term of the tenancy. 3) If this is a fixed term tenancy and the agreement does not require the tenant to vacate at the end of the tenancy, the agreement is renewed as a monthly tenancy on the same terms until the tenant gives notice to end a tenancy as required under the Residential Tenancy Act. 4) The landlord may end the tenancy only for the reasons and only in the manner set out in the Residential Tenancy Act and the landlord must use the approved notice to end a tenancy form available from the Residential Tenancy Branch. 5) The landlord and tenant may mutually agree in writing to end this tenancy agreement at any time. 6) The tenant must vacate the residential property by 1 p.m. on the day the tenancy ends, unless the landlord and tenant otherwise agree.

  • Completion of the Project The Participating County acknowledges it is obligated to undertake and complete the design and construction of the Project in compliance with all of the applicable terms and conditions of the Project Documents and the Participating County agrees to use its best efforts to cause the completion of design and construction of the Project in compliance with the applicable terms and conditions of such documents. The Participating County agrees to complete the Project in accordance with this Agreement and consistent with the scope, cost and schedule established by the Board and attached hereto in Exhibit A, as such scope, cost and schedule may be modified with the approval of Finance and the recognition of the Board.
