Customer’s Property. Title to and right of immediate possession of any property, including without limitation, patterns, tools, jigs, dies, equipment or materials furnished or paid for by the Customer shall remain in Customer. No articles made therefrom shall be furnished by Supplier to any other party without Customer’s prior written consent. Supplier may not use Customer’s property for any purpose outside the scope of Customer’s orders. Supplier shall keep adequate records of such property, which shall be made available to Customer upon request, and shall store, protect, preserve, repair and maintain such Customer’s property in accordance with sound industrial practice, all at Supplier’s expense. Unless otherwise agreed to by Customer, Supplier shall insure Customer’s interest in such the property against all risks of theft, loss or damage (including extended coverage). Copies of certificates of insurance evidencing this coverage will be furnished to Customer on demand. In the event that Xxxxxxxx’s property becomes lost or damaged Supplier agrees to pay for or replace the property, at Supplier’s expense, at Customer’s request. Supplier shall upon Customer’s request return the property at Supplier’s expense.
Customer’s Property. All property supplied to the Company by or on behalf of the Customer which is held by the Company for the purposes of the Contract or in transit to or from the Customer, shall be deemed to be entirely at the Customer’s risk and the Company shall not be liable for any loss of or damage to such property whilst in possession of the Company or in transit as afore said unless such loss or damage is due directly to the negligence of the Company, its employees or agents. In no circumstances whatsoever will the Company be liable for any consequential loss or damage arising there from. The Customer shall insure all such property for all risks.
Customer’s Property. 5.3.1 The Service Provider shall store parts and equipment removed from the Customer’s Aircraft, or shipped to the Service Provider for use or installation on the Customer’s Aircraft, in an area secure and separate from the work being done for other customers. No such parts or equipment may be used for other work without the Customer's prior written permission. Any equipment loaned by the Customer to the Service Provider for use in performing the Services shall be maintained by it in proper working order in accord- ance with the manufacturer’s instructions, and returned to the Customer when all work is completed in the same condition as when received, save for ordinary wear and tear.
Customer’s Property. The provider will only maintain fire and extended coverage on property belonging to the customer while the property is in the provider’s possession. The provider’s liability for this property will not exceed the amount recoverable from insurance. Additional insurance coverage may be obtained if it is requested in writing, and if the premium is paid to the provider. terms and conditions
Customer’s Property. 8.1 Customer’s property and all property supplied to the Company by or on behalf of the customer will be held at the customer’s risk.
Customer’s Property. Seller will maintain fire, extended coverage, vandalism, malicious and sprinkler leakage insurance on all property belonging to the customer while such property is in Seller’s possession. Seller’s liability for such property shall not exceed the amount recoverable from such insurance.
Customer’s Property. 9.1 Except in the case of a Customer who is not contracting in the course of a business or holding himself or herself out as doing so, any Customer’s property and all property supplied to Citipost by or on behalf of the Customer shall be deemed to be at the Customer’s risk whilst it is in the possession of Citipost or in transit to or from the Customer unless agreed otherwise in writing.
Customer’s Property. Materials, equipment, tools, dies, moulds, copyright, design rights or any other forms of intellectual property rights in all drawings, specifications and data supplied by Customer to Supplier or not so supplied but used by Supplier specifically in the manufacture of the Goods shall at all times be and remain the exclusive property of Customer but shall be held by Supplier in safe custody at its own risk and maintained and kept in good condition by Supplier until returned to the Customer and shall not be disposed of other than in accordance with Customer´s written instructions, nor shall such items be used otherwise than as authorised by Customer in writing.
Customer’s Property. Customer releases and hold Lessor, its agent and employees harmless from all claims for loss or damage to personal property of Customer or any other person left or carried in or upon Vehicle or any services or premise of Lessor by Customer or such other person or received, handled or stored by Lessor, at any time before, during or after this rental, whether or not same is due to Lessor’s negligence or other fault.
Customer’s Property. The Supplier will take reasonable care of the Customer’s property but the Customer bears all associated risk and the Supplier shall not be responsible for any damage to the Customer’s property. Unless it is otherwise agreed in writing the Customer shall arrange appropriate insurance cover. Unless otherwise agreed in writing, the Supplier may dispose of any materials held 12 months following the date of the invoice.
