CY PRES PAYMENT. Subject to Court approval, thirty (30) days after the Final Report the total amount of uncashed checks, and amounts held by the Claims Administrator at the time of the Final Report, shall be paid by the Claims Administrator to one or more public interest organizations nominated by the parties and subject to Court approval.

CY PRES PAYMENT. Subject to Court approval, the total amount of Residual Funds held by the Settlement Administrator after distribution of the Net Settlement Fund, shall be paid by the Settlement Administrator to an appropriate Cy Pres recipient or recipients agreed to by the Parties and approved by the Court.

The payments and the recipients of the payments shall be subject to Court approval. The Cy Pres recipients shall engage in work which affects one or more areas where Defendant maintains branches.
