CY PRES PAYMENT Sample Clauses

CY PRES PAYMENT. Subject to Court approval, thirty (30) days after the Final Report the total amount of uncashed checks, and amounts held by the Claims Administrator at the time of the Final Report, shall be paid by the Claims Administrator to one or more public interest organizations nominated by the parties and subject to Court approval.
CY PRES PAYMENT. Subject to Court approval, the total amount of Residual Funds held by the Settlement Administrator after distribution of the Net Settlement Fund, shall be paid by the Settlement Administrator to an appropriate Cy Pres recipient or recipients agreed to by the Parties and approved by the Court.
CY PRES PAYMENT. (a) Subject to Court approval, within thirty (30) days after the Final Report, the total amount of uncashed checks, and any other residual amounts held by the Settlement Administrator at the time of the Final Report, shall be paid to an appropriate cy pres recipient agreed to by the Parties and approved by the Court.
CY PRES PAYMENT. Within two hundred (200) days of the Effective Date, the total amount of uncashed checks, and amounts held by the Settlement Administrator at the time of the Final Report, shall be paid by the Settlement Administrator to cy pres recipientsagreed upon by the Parties and approved by the Court.
CY PRES PAYMENT. Thirty (30) days after the Final Report, the total amount of uncashed checks, and amounts held by the Administrator at the time of the Final Report, shall be paid by the Claims Administrator to Public Citizen Foundation, provided Public Citizen Foundation was approved by the court as the cy pres recipient. If Public Citizen Foundation is not approved by the Court, Plaintiff will nominate a different charitable organization for the Court to approve, until the Court does approve one it deems appropriate.
CY PRES PAYMENT. Thirty (30) days after the Final Report, the total amount of uncashed checks, and amounts held by the Claims Administrator at the time of the Final Report, shall be paid by the Claims Administrator (50/50) to Communities in Schools Marietta./Cobb County and Georgia Watch, subject to approval by the Court. If the Court were not to approve Communities in Schools Marietta./Cobb County and/or Georgia Watch as the cy pres recipient, Plaintiff and Defendant will propose another non-profit organization until one is approved by the Court.
CY PRES PAYMENT. Thirty (30) days after the Final Report, the total amount of uncashed checks, and amounts held by the Claims Administrator at the time of the Final Report, shall be paid by the Claims Administrator as follows: 50% shall be paid to Public Citizen, and 50% shall be paid to Junior Achievement of Boston. The payments and the recipients of the payments shall be subject to Court approval. The Cy Pres recipients shall engage in work which affects one or more areas where Defendant maintains branches.
CY PRES PAYMENT. Thirty (30) days after the Final Report, the total amount of uncashed checks, and amounts held by the Claims Administrator at the time of the Final Report, shall be paid by the Claims Administrator to Junior Achievement of Southwest Michigan, subject to approval by the court. If the court were not to approve Junior Achievement of Southwest Michigan as the cy pres recipient, Plaintiff will propose other non-profit organization doing work in the sphere of consumer rights including issues similar to those involved in this lawsuit for 50% of the cy pres until one is approved by the court, and Defendant will propose other non-profit organizations for the other 50% of the cy pres award until approved by the court.
CY PRES PAYMENT. Within three hundred sixty days (360) days after the Effective Date, Class Counsel will submit a Final Report to the Court of the total amount of uncashed, undeliverable, and/or otherwise unclaimed checks and residential amounts held by the Settlement Administrator. Subject to Court approval, within thirty (30) days after the Final Report, the total amount of uncashed, undeliverable, and/or otherwise unclaimed checks and residential amounts held by the Settlement at the time of the Final Report, shall be paid as follows: (1) subject to the requirements of Indiana Rule of Trial Procedure 23(F)(2), twenty-five percent (25%) to Lacasa, Inc., twenty-five percent (25%) to Project Impact South Bend, Inc., and fifty percent (50%) to the Indiana Bar Foundation to support the activities and programs of the Indiana Pro Xxxx Commission and its pro xxxx districts, or such other beneficiary as the Parties and the Court shall agree at the time of the Final Approval Order.
CY PRES PAYMENT. Subject to Court approval, within thirty (30) calendar days after the Final Report, the total amount of uncashed checks, and the amounts held by the Claims Administrator at the time of the Final Report, shall be paid by the Claims Administrator to a cy pres recipient as nominated by Plaintiffs but agreed to by Defendant and consistent with the South Carolina rules on cy pres funds. If the parties are unable to agree on a cy pres recipient, they will each submit their proposed nominee to the Court in the Motion for Final Approval and the Court will decide the cy pres recipient.
