Residual Funds. Full-time faculty who are hired after January 1, 2005 will not receive residual funds from the District health and welfare contribution of five thousand two hundred dollars ($5,200). Residual funds are defined as those moneys left over from the District contribution of five thousand two hundred dollars ($5,200) after the full-time faculty member has selected his/her health, dental, and mandatory life insurance coverage.
Residual Funds. The Settlement is designed to exhaust the Settlement Fund. To the extent any monies remain in the Net Settlement Fund more than 120 days after the distribution of all Settlement Payments to the class members, a subsequent Settlement Payment will be evenly made to all Class Members with approved claims for Cash Fund Payments who cashed or deposited the initial payment they received, provided that the average check amount is equal to or greater than Three Dollars and No Cents ($3.00). The distribution of this remaining Net Settlement Fund shall continue until the average check or digital payment in a distribution is less than three dollars ($3.00), whereupon the amount remaining in the Net Settlement Fund, if any, shall be distributed by mutual agreement of the Parties to a Court-approved non-profit recipient. Should it become necessary to distribute any remaining amount of the Net Settlement Fund to a Court-approved non-profit recipient, the Parties shall petition the Court for permission to do so, providing the Court with details of the proposed non-profit recipient.
Residual Funds. For purposes of this Agreement, the term “Residual Funds” means Direct Service Worker Reimbursement Rate funds that are to compensate and pay required tax and other withholdings (state and/or federal) for Participant’s DSW/employee, that are retained and not spent by the Participant during the term of the Agreement. Participant may utilize such Residual Funds pursuant to the following:
Residual Funds. If any monies remain in the Qualified Settlement Fund more than one hundred twenty (120) days after the distribution of Settlement Payments, a subsequent payment will be distributed to a Non-Profit Residual Recipient subject to court approval.
Residual Funds. 1. Monies, if any, remaining in the Settlement Fund Account as a result of the accrual of interest on the Fund after the settlement amounts were calculated and/or any Residual Funds shall be distributed to Volunteer Connections of Central Alabama, a 501(c)(3), tax exempt organization located in Alexander City that assists seniors, low income persons, and the local community.
Residual Funds. Any funds remaining in the Trust upon completion of all required Environmental Response Actions shall be distributed to DEC to be used for any lawful purpose within DEC’s sole discretion.
Residual Funds. All Residual Funds remaining in any account maintained by the Claims Administrator for purposes of administering this settlement shall be disbursed to a cy pres recipient to be agreed upon by the Parties and approved by the Court.
Residual Funds. For any Settlement Payment funds which remain in the Settlement Fund Account one year after the Payment Date—consisting of checks that were successfully delivered but not timely negotiated, and checks deemed undeliverable by the Settlement Administrator (collectively, “Residual Funds”)—such Residual Funds shall be treated as unclaimed property of the corresponding accountholders, subject to applicable state unclaimed property procedures; provided that any administrative costs of the Settlement Administrator in connection with the distribution of the Residual Funds pursuant to this Section IV.C.5 shall be paid from the Residual Funds, shall not increase AT&T’s monetary obligation under this Settlement Agreement, and shall reduce pro rata the respective unclaimed property amounts for the accountholders with uncashed or undeliverable Settlement Payment checks. Nothing contained in this Section IV.C.5 shall impose any obligations on AT&T, and the Settlement Administrator shall be responsible for performing any and all obligations that may be required by any state’s unclaimed property laws and procedures in connection with any Residual Funds.
Residual Funds. For residual amounts remaining in the Preventive Measures Claims Settlement Administration Fund as of one (1) year following the Effective Date, due to uncashed checks and/or as a result of the $1,500/$500 per Claimant payment caps (described above), such residual amounts (the “Residual Funds”) shall be distributed as follows:
(a) To the extent economically feasible and practical in light of the costs of administering such subsequent payments (all costs of administering such additional payments to be paid from the Preventive Measures Claims Settlement Administration Fund), and subject to agreement by Class Counsel and SPE, the residual funds shall be distributed on a pro rata basis to Settlement Class Members who, as of one (1) year following the Effective Date, have enrolled in AllClear PRO in connection with the SPE Cyberattack; or
(b) If an additional distribution is not economically feasible and practical, or if an additional distribution is made pursuant to section 10(a) above and there are funds remaining in the Preventive Measures Claims Settlement Administration Fund following such additional distribution that would be not be economically feasible and practical to distribute to Settlement Class Members, the residual funds shall be distributed through a cy pres program to a non-profit organization, to be agreed upon by SPE and Class Counsel and approved by the Court, to be used to promote education about how consumers can protect themselves from identity theft. The parties’ proposed designee organization shall be identified on the Settlement Website once selected.
(c) If Class Counsel and SPE are unable to agree on a distribution plan for the Residual Funds, they shall bring the matter, together with supporting materials and argument, to the Court for determination. All costs of administering any distribution of Residual Funds shall be paid from the Preventive Measures Claims Settlement Administration Fund.
