Common use of Damage to Personal Property Clause in Contracts

Damage to Personal Property. Where an employee's personal property, excluding private automobiles, utilized in the performance of their duties is damaged by a client, patient, or resident while the employee is carrying out their duties, and the damages are not covered by Workers' Compensation or insurance, the Employer shall reimburse the employee for the necessary repairs or replacement.

Where an employee's personal property, excluding private automobiles, utilized which is required and is used in the performance of their duties her/his duties, is damaged by a client, patient, or resident child while the employee is carrying out their his/her duties, and where the damages are not covered by Workers' Compensation or insurance, the Employer shall reimburse the employee for all or a portion of the cost of the necessary repairs or replacement.
