Day Use. The small picnic area has 1 picnic site and a parking lot behind the kiosk for 8 cars. Two other smaller restrooms Natural Resources Xxxxxxx Bridge Natural Preserve across the river is a significant feature that is only accessible by private watercraft and is NOT operated by Concessionaire nor included as part of the Premises. This 130 acre dense native riparian forest is a winter home to the Bald Eagle and a summer nest site for the Yellow Billed Cuckoo. This jungle like grove displays some of the last remaining riparian habitat to be found in California. Over a hundred plant species have been identified throughout the park; the most prominent is the large valley oak. The California black walnut, Oregon ash, black cottonwood, sycamore, and willow are also plentiful. Beneath the oaks and cottonwoods along the river is a profusion of elderberry, wild grape, and wildflowers in season. Housing This unit has: • Employee Residences o No fixed structure homes • Employee Trailer Pads o One pad for a single wide trailer has full hookups--sewer, water, electrical • Host Site o One site in campground with full hookups Xxxxxxx Island State Recreation Area Park unit details are available at xxxx://xxx.xxxxx.xx.xxx/?page_id=487. The concessionaire will operate the overnight, day use and recreational facilities of this 336 acre recreation area which opened in 1965. The recreation area is bordered by the Sacramento River to the west, Three Mile Slough on the south, and Seven Mile Slough to the east. Current projects include:

Day Use. Manage, operate, and maintain a dedicated day use area which provides picnic tables, barbeque grills, and access to the lake in accordance with this Concession Contract and in the required quantities shown in Section 2.B of this contract. The day use area must be dedicated to single-day visitors and cannot be used for overnight visitation.
Day Use. Licensees may offer day use resort passes for use at the Eagle Crest Resort and Running Y Ranch Resort ("Day Passes") to WorldMark Members who purchase from Licensees. As a condition to offering Day Passes, Licensees will disclose in writing to each WorldMark Member that the Day Pass: (i) is not being offered by WorldMark; (ii) is not a WorldMark product or program; (iii) cannot be used at any other WorldMark resort; and (iv) may be terminated at any time without prior notice.
Day Use. Eagle Crest may elect to offer day use resort passes to former ECVC Members for use at the Eagle Crest Resort and Running Y Ranch Resort. Eagle Crest, however, shall be under no obligation to offer such passes to other WorldMark Members.

  • Day not a Business Day If any day on or before which any action or notice is required to be taken or given hereunder is not a Business Day, then such action or notice shall be required to be taken or given on or before the requisite time on the next succeeding day that is a Business Day.

  • License; Use Upon delivery to an Authorized Person or a person reasonably believed by Custodian to be an Authorized Person of the Fund of software enabling the Fund to obtain access to the System (the “Software”), Custodian grants to the Fund a personal, nontransferable and nonexclusive license to use the Software solely for the purpose of transmitting Written Instructions, receiving reports, making inquiries or otherwise communicating with Custodian in connection with the Account(s). The Fund shall use the Software solely for its own internal and proper business purposes and not in the operation of a service bureau. Except as set forth herein, no license or right of any kind is granted to the Fund with respect to the Software. The Fund acknowledges that Custodian and its suppliers retain and have title and exclusive proprietary rights to the Software, including any trade secrets or other ideas, concepts, know-how, methodologies, or information incorporated therein and the exclusive rights to any copyrights, trademarks and patents (including registrations and applications for registration of either), or other statutory or legal protections available in respect thereof. The Fund further acknowledges that all or a part of the Software may be copyrighted or trademarked (or a registration or claim made therefor) by Custodian or its suppliers. The Fund shall not take any action with respect tot the Software inconsistent with the foregoing acknowledgement, nor shall the Fund attempt to decompile, reverse engineer or modify the Software. The Fund may not xxx, sell, lease or provide, directly or indirectly, any of the Software of any portion thereof to any other person or entity without Custodian’s prior written consent. The Fund may not remove any statutory copyright notice or other notice included in the Software or on any media containing the Software. The Fund shall reproduce any such notice on any reproduction of the Software and shall add any statutory copyright notice or other notice to the Software or media upon Custodian’s request.

  • Permitted Uses Tenant may use the Property only for the Permitted Uses set forth in Section 1.06 above.

  • Exclusive Use (A) After the Occupancy Date, Lessee expressly agrees and warrants that the Leased Premises will be used exclusively as a Champps Restaurant or other casual dining sit-down restaurant. In any other such case, after obtaining Lessor's prior written consent, such consent not to be unreasonably withheld or delayed, Lessee may conduct any lawful business from the Leased Premises. Lessee acknowledges and agrees that any other use without the prior written consent of Lessor will constitute a default under and a violation and breach of this Lease. Lessee agrees: To open for business within a reasonable period of time after completion of construction of the contemplated Improvements; to operate all of the Leased Premises during the Term or Renewal Terms during regular and customary hours for businesses similar to the permitted exclusive use stated herein, unless prevented from doing so by causes beyond Lessee's control or due to remodeling; and to conduct its business in a professional and reputable manner.

  • Permitted Use Tenant shall use the Premises solely for the Permitted Use set forth in Section 7 of the Summary and Tenant shall not use or permit the Premises or the Project to be used for any other purpose or purposes whatsoever without the prior written consent of Landlord, which may be withheld in Landlord’s sole discretion.

  • Local Business Day The definition of Local Business Day in Section 14 is hereby amended by the addition of the words “or any Credit Support Document” after “Section 2(a)(i)” and the addition of the words “or Credit Support Document” after “Confirmation”.
