Dealing in different capacities. The Facility Agent may: (a) engage in any kind of banking, trust or other business with an Obligor or a Guarantor or the Financiers or any of their Related Entities; and (b) accept fees and other consideration from an Obligor, a Guarantor or any of their Related Entities for services in connection with the Bank Finance Documents or any other arrangement; and (c) act as Registrar, in accordance with this agreement and the Loan Note Deed Poll, as if it were not the Facility Agent and without having to account to the Financiers for any income it derives in doing so. The Financiers release the Facility Agent from any obligation the Facility Agent might otherwise have to the Financiers in relation to these matters. In acting as agent for the Financiers, the Facility Agent is to be regarded as acting through its agency division which is to be treated as a separate entity from any other of its divisions or departments. Dealing in different capacities. (a) The Security Trustee may: (i) engage in any kind of banking, trust or other business with any Security Provider or any Beneficiary; and (ii) accept fees and other consideration from any Security Provider for services in connection with the Loan Documents or any other arrangement, as if it were not the trustee of the Security Trust. The Security Trustee need not notify the Beneficiaries if it does so, nor account to the Beneficiaries for any income or other benefit it derives in doing so, and the Beneficiaries release the Security Trustee from any obligation it might otherwise have to the Beneficiaries in relation to those matters. (b) In this clause 6.4, a reference to the Security Trustee, a Beneficiary or a Security Provider includes any Affiliate of those persons.   • Actions We May Take if You Engage in Any Restricted Activities If we believe that you’ve engaged in any of these activities, we may take a number of actions to protect PayPal, its customers and others at any time in our sole discretion. Employees eligible for shift differential are those whose work shift begins before 6:00 a.m. or ends on or after 7:00 p.m. and are scheduled by their supervisor for a total shift of at least six (6) hours in duration. Tenant hereby acknowledges that the premises they have reserved may include a pool and the undersigned agrees and acknowledges that the pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the community pool and patio areas.
