Common use of Defendant in Civil Action Clause in Contracts

Defendant in Civil Action. Whenever an employee is named as a defendant in a civil 17 action arising out of the performance of the employee’s duties and, acting within the scope of 18 employment, the Prosecuting Attorney’s Office shall, at the written request of the employee, furnish 19 counsel to represent the employee to the final determination of the action, without cost to the 20 employee. Where a possible conflict exists between the County and the employee, the Prosecuting 21 Attorney may, at his or her sole discretion, appoint outside counsel as a special deputy prosecuting 22 attorney to represent the employee. In such cases, the County shall be responsible for payment of 23 costs incurred in such defense. This provision will be governed by the terms of King County Code 24 2.21.050.
