Delivery of the Expansion Space. When Landlord’s Work is Substantially Complete, subject to the remaining terms and provisions of this Section 3(e), Tenant shall accept the Expansion Space. Tenant’s taking possession and acceptance of the Expansion Space shall not constitute a waiver of: (i) any warranty with respect to workmanship (including installation of equipment) or material (exclusive of equipment provided directly by manufacturers), (ii) any non-compliance of Landlord’s Work with applicable Legal Requirements, or (iii) any claim that Landlord’s Work was not completed substantially in accordance with the TI Construction Drawings (subject to Minor Variations and such other changes as are permitted hereunder) (collectively, a “Construction Defect”). Tenant shall have one year after Substantial Completion within which to notify Landlord of any such Construction Defect discovered by Tenant, and Landlord shall not be in default under the Lease but Landlord shall, in a diligent manner, remedy or cause the responsible contractor to remedy any such Construction Defect. Tenant shall be entitled to receive the benefit of all construction warranties and manufacturer’s equipment warranties relating to equipment installed in the Expansion Space. If requested by Tenant, Landlord shall attempt to obtain extended warranties from manufacturers and suppliers of such equipment, but the cost of any such extended warranties shall be borne solely out of the TI Fund. Landlord shall promptly undertake and complete, or cause to be completed, all punch list items.
Delivery of the Expansion Space. Landlord shall deliver the Expansion Space (which shall be equal to the amount of space desired by Tenant plus or minus up to 1,000 rentable square feet) to Tenant at any time prior to the end of the eighth (8th) month of the 5th Lease Year, at Landlord's option (the "Delivery Period"). The delivery of the Expansion Space may, at Landlord's option, be in increments, and the Expansion Space may consist of one or more (but no more than three (3)) separate spaces in one or more buildings of the Project.
Delivery of the Expansion Space. In the event Tenant duly delivers the Expansion Exercise Notice, Landlord shall deliver the Expansion Space to Tenant on or after October 1, 2001 but before January 1, 2002 (which period shall be extended day for day by Force Majeure Delays and Tenant Delays [as such terms are defined in the Work Letter Agreement]).
Delivery of the Expansion Space. Landlord shall deliver the applicable Expansion Space to Tenant as soon as reasonably practicable following the vacation and surrender thereof by the existing tenant therein.
Delivery of the Expansion Space. The “Expansion Space” is shown on Exhibit A-3 hereto and incorporated herein. The Delivery Date for the Expansion Space shall be March 1, 2013, and Landlord shall deliver the Expansion Space on such date, free and clear of any other occupancy rights. Upon delivery, the Expansion Space shall be a part of the Leased Premises for all purposes under the Lease. The later of the date Landlord so delivers the Expansion Space and March 1, 2013 shall be the “Effective Date”.
Delivery of the Expansion Space. Landlord shall deliver the Expansion Space to Tenant upon Substantial Completion of the Expansion Space Tenant Improvements (as such term is defined in Section 31E). For purposes of this Section 31 only, "Substantial Completion" shall occur upon the completion of construction of the Expansion Space Tenant Improvements in the Premises pursuant to the approved working drawings (if any), with the exception of any punch list items and any tenant fixtures, work-stations, built-in furniture, or equipment to be installed by Tenant.
Delivery of the Expansion Space. Landlord shall use commercially reasonable efforts to deliver the Expansion Space to Tenant within one hundred twenty (120) days after the Expansion Date (or, if Tenant delivers the Accelerated Expansion Notice, as soon as reasonably possible after the lease amendment is fully executed and delivered by Landlord and Tenant).
Delivery of the Expansion Space. Landlord shall deliver the Expansion Space to Tenant upon substantial completion of the Tenant Improvements thereto, subject to mutual execution of the Expansion Amendment (defined below), Tenant’s payment of the first (1st) month’s Base Rent therefor and any additional Security Deposit (proportionate with the initial Security Deposit provided for the Premises), and delivery of evidence of insurance required to be obtained by Tenant with respect to the Expansion Space.
Delivery of the Expansion Space. Landlord shall deliver the Expansion Space to Tenant on or before the Expansion Date.
Delivery of the Expansion Space. Lessor shall deliver the Expansion Space to Lessee within thirty (30) days of the earlier to occur of the Expiration Date or the date specified in 1.1(B) above (the "DELIVERY DATE"), unless either (i) Lessor agrees to install certain Tenant Improvements pursuant to section 1.3 below, in which case the Delivery Date shall occur upon the substantial completion of such tenant improvements by Lessor, or (ii) the Current Tenant holds over beyond the Expiration Date, in which event the Delivery Date shall be delayed by the number of days the Current Tenant holds over in its possession of the Expansion Space.
