Subject to the Special Conditions, each Day during the months of November through and including March of the Delivery Period, Seller shall have the right to supply, sell, and deliver to Buyer, and ▇▇▇▇▇ agrees to be supplied with, purchase and receive from Seller a quantity of Gas up to the TMDQ, plus applicable Fuel.
Seller and Buyer shall cooperate to provide all requisite notifications to Transporter, including that such release is a permanent capacity release made to an asset manager (Buyer), is exempt from bidding pursuant to Sections 284.8(h)(1)(i) and (h)(3) of FERC’s regulations and Transporter’s applicable Tariff provisions, the volumetric level of Buyer’s purchase obligations (i.e., up to the TMDQ), and the period during which that obligation is in effect (i.e., the Delivery Period).
Seller will request the Utility to enroll Customer on the first meter read date within the Delivery Period.
Any new tariff charges that become effective after the Utility completes Customer’s enrollment and Vendor's services commence (the commencement of the "Delivery Period") may be directly passed through to Customer by a corresponding increase in the Price.
For the Delivery Period, Seller selects and designates Buyer to serve as asset manager for the Released Capacity pursuant to and consistent with the requirements of FERC Order No. 712 and FERC’s regulations.
