Common use of DEMOTIONS AND SENIORITY Clause in Contracts

DEMOTIONS AND SENIORITY. When a shortage of work occurs which necessitates a reduction in the work force the employee with the least classification seniority within the department affected shall be laid off. It is understood that: (i) An employee who is laid off may be demoted to a lower classification provided that work is available. (ii) An employee who is laid off may exercise his/her seniority within the Company and displace an employee in a classification only provided he/she has worked in that classification immediately prior to his/her present classification. (iii) An employee who is transferred to another job under the provisions of (i) or (ii) shall be paid the rate applicable to the job to which he/she is transferred.
