Scheduling of Shifts. 36.4.1 Schedules of hours of work, which cover the normal work requirements, shall be posted by the Council at least fifteen (15) calendar days in advance of the starting date of the new schedule. Scheduling of Shifts. (a) The Employer, in scheduling shifts, shall take into consideration an Employee’s request for certain shift schedules. The shift patterns which may be available are: (i) days, evenings, nights (rotation); (ii) days only; (iii) evenings only (by Employee request); (iv) nights only (by Employee request); (v) days and evenings (rotation); (vi) days and nights; (vii) evenings and nights (by Employee request (rotation)). (b) Should an Employee work a shift schedule where she does not work day shift during the week, the Employer shall have the right to assign periods of day duty for the purpose of evaluating or maintaining and improving competency and proficiency of skills. This assignment to day duty shall not total more than one hundred and sixteen point twenty-five (116.25) hours worked in a calendar year. (c) Except in cases of emergency or by mutual agreement between a Regular Employee and the Employer, shift schedules shall provide for: (i) at least fifteen and one-half (15 1/2) hours off-duty between regularly scheduled shifts; (ii) at least two (2) consecutive days of rest except that, twice in a two (2) week cycle, there may be a single day of rest which may be followed by not more than six (6) consecutive working days; (iii) days of rest on at least two (2) weekends in a five (5) week period. "Weekend" shall mean a Saturday and the following Sunday, assuring a minimum of fifty-six (56) hours off duty;
Scheduling of Shifts. The Employer may schedule an afternoon and/or night shift if/as required. It shall not be necessary for there to be a day shift in order for there to be an afternoon shift and/or a night shift. Nor shall it be necessary to maintain an afternoon shift and/or night shift for consecutive days in order to constitute such a shift.

For purposes of verification, a period of twelve (12) complete weeks commencing with the start of a shift schedule will be used for such longer period as may be mutually agreeable with the staff concerned. ** (f) There shall be a time period of at least sixteen (16) hours elapsing between changes to scheduled shifts. Failure to schedule sixteen (16) hours off without mutual consent will result in premium pay at time and a half (1 ½) the nurse's regular straight time hourly rate. (g) An employee who is required to change his scheduled shift without receiving at least forty-eight (48) hours' notice in advance of the starting time of such change in his scheduled shift, shall be paid for the first (1st) shift worked on the revised schedule at the rate of time and one-half (1 ½). Subsequent shifts worked on the revised schedule shall be paid for at the hourly rate of pay. (h) Notwithstanding anything to the contrary contained in this Agreement, the implementation of any variation in hours (clause B1.03) shall not result in any additional overtime work or additional payment by reason only of such variation, nor shall it be deemed to prohibit the right of the employer to schedule any hours of work permitted by the terms of this Agreement. Scheduling of Shifts. Scheduling Hours of Work 39.1 It is recognized the Company has the right to schedule the hours of operation and employee hours of work to meet the changing needs of the business. It is further acknowledged the Company acknowledges the need to appreciate an employee’s requirement for work life balance. Shift patterns and scheduling priorities will ac- knowledge this along with operational needs. 39.2 The Company and the Union agree the business xxx- xxxx for this industry is in flux and will make reasonable efforts to plan for known occurrences (such as promo- tions, events, New Year’s and other holidays), where additional employees may be required, shall be ac- counted for when shifts are being arranged. Requests for time off will be taken into consideration and become part of the planning process. Posting Shift Schedules 39.3 The Company will post the various working schedules in appropriate location two (2) weeks in advance. The Company will give at least four (4) calendar daysnotice of its intent to change an employee’s schedule, except in cases of emergency. Shift Cancellation 39.4 When an employee reports for work at the customary time scheduled for him/her without being notified to the contrary and is assigned less than four (4) hours of work, he/she shall be paid at least four (4) hours at the employee’s base rate of pay. Maximizing Shift Lengths 39.5 While the Company is entitled to schedule shifts of var- ious lengths as provided for in this Agreement, the Company will maximize the length of shifts through the work week before instituting a shift of lesser duration.
