Discipline for Violation of Section 3. 2. The failure or refusal on the part of any employee to comply with the provisions of Section 3.2 of this Agreement shall be cause for immediate discipline, including discharge. The failure or refusal by a Union officer, agent, representative, employee representative, xxxxxxx, or committeeman to comply with the provisions of Section 3.2 of this Agreement constitutes leading and instigating a violation of said Section 3.2, it being specifically agreed that the Union officers, agents, representatives, employee representatives, stewards, and committeemen, by accepting such positions, have assumed the responsibility of affirmatively preventing violations of Section 3.2 of this Agreement by reporting to work and performing work as scheduled or required by the Company. Nothing in this Section 3.3 will preclude nor waive the right of the employee, the Union, or the Company to bring or file any claim under the National Labor Relations Act before the National Labor Relations Board or in court, as appropriate.

The University will notify the F.O.P. of any violation of Section 3.1, and such F.O.P. officers and Representatives will immediately take actions reasonably calculated to end the violation. The failure or refusal by a F.O.P. officer or Representative to comply with the provisions of Section 3.1 of this Agreement, or the preced- ing sentence, constitutes leading and instigating a violation of said Section 3.1, it being specifically agreed that the F.O.P. officers and representatives, by accepting such positions, have assumed the responsibility of affirmatively preventing xxxxx- tions of Section 3.1 of this Agreement by reporting to work and performing work as scheduled and/or required by the University.
