(a) Advertising and Publicity: LIVE and Orion will meaningfully consult with each other in good faith and will mutually develop an advertising and publicity strategy for each Film; in the event of any disagreement, LIVE's decision will prevail so long as LIVE's decision does not result in the expending of money by Orion xxxxxd the expenses reimbursed by LIVE and so long as LIVE's decision is reasonable taking into account the nature of the Film and the business relationships of both Orion and LIVE. The advertising and publicity strategy for each Film includes the design of advertising and publicity materials, the determination of monies to be spent on electronic versus print media and coordination of publicity tours and interviews.
Distribution and Marketing. 5.7.1 Bio-Implant Allografts will be maintained at Osteotech on behalf of LifeNet and its Alliance Partners for distribution and invoicing to Customers, including those extended to hospital consignment and field representative programs. Bio-Implant Allograft order processing details will be defined and must be acceptable to both LifeNet and Osteotech. LifeNet will provide tissue-related marketing materials which Osteotech does not provide, including artwork, package labeling, inserts, etc.. At LifeNet's sole discretion, after at least 90 days prior written notice to, and consultation with Osteotech, LifeNet shall have the right to elect to distribute Bio-Implant Allografts, which have been processed from LifeNet and its Alliance Partners' tissue, directly from LifeNet and/or its Alliance Partners ("Distribution Election").
Distribution and Marketing. 4.2.1 The parties agree that Bona Film and its subsidiaries or affiliates shall act as the exclusive distributor (the “Distributor”) of the Target Projects in the territory of mainland China (excluding Hong Kong, Macau and Taiwan), fully responsible for project distribution and marketing throughout mainland China.
