DISTRICT FUNCTIONS. A. It is recognized that the District has the rights and responsibilities to operate and manage the school system and its programs, facilities, properties and school activities of its employees except as specifically provided in this Agreement. B. Without limiting the generality of the foregoing (paragraph A), it is expressly recognized that the District’s operations and managerial responsibility includes: 1. The right to determine location of the schools and other facilities of the school system, including the right to establish new facilities and relocate or close old facilities. 2. The determination of the financial policies of the District, including the general accounting procedures, inventory of supplies and equipment procedures and District public relations. 3. The determination of the management, supervisory or administrative organization of each school or facility in the system and the selection of employees for promotion to supervisory, management or administrative positions. 4. The maintenance of discipline and control and use of the school system property and facilities. 5. The determination of safety, health and property protection measures where legal responsibility of the District or other governmental unit is involved. 6. The right to enforce the policies, the rules and the regulations now in effect and to establish new rules and regulations from time to time not in conflict with this Agreement. 7. The direction, transfer and assignment of all the working forces in the system, including the right to hire, suspend or discharge. 8. The creation, combination, modification or elimination of any position(s). 9. The determination of the size of the working force, the allocation and assignment of work to employees, the determination of policies affecting the selection of employees, and the establishment of quality standards and judgment of employee performance. 10. The determination of the processes, techniques, methods and means of teaching and the subjects to be taught through mutual cooperation. 11. The right to schedule classes and assign work leads and to select textbooks, teaching aids and materials through mutual cooperation. Nothing in this contract shall restrict the District’s right to contract or subcontract out bargaining unit work and/or work currently being performed by members of the bargaining unit. This reserved right is without qualification; there is no District obligation to bargain as to any contracting or subcontracting decision and the impact thereof. This is understood to be a waiver of the right to demand decisional and impact bargaining. The Association and the District shall have no obligation to negotiate on any subject during the term of this Agreement except as specifically provided by this contract or by law.
