Common use of DISTRICT RIGHTS AND RESPONSIBILITIES Clause in Contracts

DISTRICT RIGHTS AND RESPONSIBILITIES. 1. It is understood and agreed that the District retains all of its powers and authority to direct, manage, and control its operations to the full extent of the law, except as specified in this Agreement. 2. The exercise of the foregoing powers, rights, authority, duties, and responsibilities by the District; the adoption of policies, rules, regulations, and practices in furtherance thereof; and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement and by applicable law. 3. The District retains the right to amend, modify or rescind policies and practices referred to in this Agreement during cases of emergency within the context of Federal and State law. An emergency is defined as a natural or man-made catastrophe or action which interrupts or terminates the normal and ordinary conduct of school. Upon resolution of the emergency conditions, all policies and practices of this Agreement shall be reinstated.
