- District Rights and Responsibility. 3.1 Subject only to the expressed limitations stated in this agreement, or in any other arrangement between the employer and the Union (Memo of Understanding or Letter of Agreement), during the term of this agreement it is agreed that the customary and usual rights, powers, functions, responsibilities, and authority of management are vested in management officials of the District. 3.2 The right to make rules and regulations are considered acknowledged functions of the District. Included in these rights in accordance with applicable laws and regulations and this collective bargaining agreement are: 1. The right to make rules and regulations relating to personnel policies; 2. The right to direct the work force; 3. The right to hire, promote, retain, transfer, and assign employees inpositions; 4. The right to release employees from duties because of lack of work or other legitimate reasons; 5. The right to maintain efficiency of the District operations by determining the methods, the means, and the personnel by which such operation is conducted; 6. To take whatever actions are necessary in emergencies in order to assure the proper operation of theDistrict.
