Drug/Alcohol Addiction. 1. The Association and District jointly recognize drug/alcohol addiction as an illness which is treatable. It is also recognized that it is for the best interests of the employee the Association and the District that these illnesses be treated and controlled under the existing collective bargaining contractual relationship.

It also is recognized that it is in the best interest of the 39 employee and the Parties that these illnesses be treated and controlled under the 40 existing Employee Assistance Program. 41 42 Except for conduct that violates Subsection 1 and Subsection 4, the concern of the 43 Parties is limited to drug/alcohol addiction that causes poor attendance and 44 unsatisfactory performance on the job. The sole objective is to help, not harm, the 45 employee. The Employee Assistance Program is designed for rehabilitation, not 46 elimination or discipline of the employee. 47 48 Any employee who participates in the Employee Assistance Program will be entitled 49 to all of the rights and benefits provided to other employees who are sick, in 1 addition to specific services and assistance that this program may provide, and all 4 It shall also be the responsibility of the District to assure any drug/alcohol-addicted 5 employee that a request for diagnosis or treatment will not jeopardize his/her job

The District will respect the employee’s rights to privacy, dignity, and security, and strict confidentiality will be observed at all times.
