Duty of information. The Company must inform the Factor as soon as possible of any acts or events likely to affect the rights of the latter over the transferred debts. In case of characterized or reiterated lack by the Company of its information obligations, the Factor will be able to declare the loss of right of all guarantees issued on the outstanding amounts of the transferred debts and to claim repayment of the losses sustained. The Company acknowledges to the Factor as well as to any person designated by it, the right to obtain communication of all documents to ensure the respect of the contractual obligations. It is bound to facilitate for the Factor exercise of this right and to send to the Factor, within the legal time-limits, its statement, certified by its auditors in cases stipulated by the law, as well as the appended documents.
