Duty to Repair, Restore, or Replace. Prior to termination of this Agreement and unless GRANTOR has conveyed the Site to GRANTEE, GRANTEE shall restore the Site to its original condition. Restoration shall include the repair or replacement of any landscaping, structures, fences, driveways, or other improvements that are removed, damaged, or destroyed by Developer’s employees, contractors, subcontractors, agents and designees.

Duty to Repair, Restore, or Replace. Prior to termination of this Agreement and unless GRANTOR has conveyed the City Property to GRANTEE, GRANTEE shall repair or replace any landscaping, structures, fences, driveways, or other improvements that are removed, damaged, or destroyed by Developer’s employees, contractors, subcontractors, agents and designees in connection with the Investigations.
Duty to Repair, Restore, or Replace. Prior to termination of this Right of Entry, GRANTEE shall restore portions of the Property to its original condition except to the extent approved in writing by the GRANTOR. Restoration shall include the repair or replacement of any landscaping, structures, fences, driveways, or other improvements that are removed, damaged, or destroyed by GRANTEE’S employees, contractors, subcontractors, agents, and designees.
Duty to Repair, Restore, or Replace. Prior to termination or expiration of this Agreement, Developer shall ensure that all vehicles and property are removed and the Property is restored and repaired such that the condition of the Property is in a state equal to or better (as determined by the Public Works Director) than it existed prior to the execution of this Agreement. If Developer fails to remove such vehicles and property or repair/restore the Property as required, to the reasonable satisfaction of the Public Works Director, within 10 days of the termination or expiration of this Agreement and receipt of written notice from the City it shall be liable for liquidated damages in the amount of $1,000 per day. In such event, and provided Developer has not already reached agreement in writing with the City to complete such work, the City shall have the option of repairing/restoring the Property at Developer’s expense. Any cost incurred by the City in so doing shall constitute a debt of the Developer to the City, recoverable by the City in any manner provided by law, and shall be in addition to any liquidated damages due.

  • Repair Concessionaire shall, prior to the commencement of the Concession Operation under the Agreement, provide to Department a type-written concession equipment maintenance plan for the State-owned equipment located on the Concession Premises, together with a schedule for preventative maintenance and a report on maintenance completion and equipment condition. Failure to comply with this preventative maintenance schedule shall result in Concessionaire being responsible for all repairs and/or replacement of equipment. The review and Department inspection of the Concession Premises and its equipment will be conducted during routine inspection of the Concession Premises and as a part of the Mandatory Compliance and Performance Evaluation Meetings.

  • Repair and Replacement Subject to obtaining prior written permission of the Authority and any instructions/specifications issued by the Authority, the Operator may if need so arises, replace or install any equipment or accessory for beyond the specifications inside or on the outside of the Contracted Buses. In the event the Operator replaces or installs any equipment or accessory in accordance with this provision, it shall ensure that such additional equipment or accessory is compatible with the existing bus components, parts, software, accessories, or equipment.

  • Maintenance, Alteration and Repair (a) Resident is responsible for and agrees to take good care of the premises, fixtures and all common areas.   • MAINTENANCE, REPAIRS, OR ALTERATIONS The Tenant shall, at their own expense and at all times, maintain premises in a clean and sanitary manner, and shall surrender the same at termination hereof, in as good condition as received, normal wear and tear excepted. The Tenant may not make any alterations to the leased premises without the consent in writing of the Landlord. The Landlord shall be responsible for repairs to the interior and exterior of the building. If the Premises includes a washer, dryer, freezer, dehumidifier unit and/or air conditioning unit, the Landlord makes no warranty as to the repair or replacement of units if one or all shall fail to operate. The Landlord will place fresh batteries in all battery-operated smoke detectors when the Tenant moves into the premises. After the initial placement of the fresh batteries it is the responsibility of the Tenant to replace batteries when needed. A monthly "cursory" inspection may be required for all fire extinguishers to make sure they are fully charged.

  • MAINTENANCE AND REPAIR; RULES Tenant will, at its sole expense, keep and maintain the Premises and appurtenances in good and sanitary condition and repair during the term of this Agreement and any renewal thereof. Without limiting the generality of the foregoing, Tenant shall:

  • Repair or Replacement (1) Unless a dispute resolution process has been initiated, the Insurer, instead of making payment, may repair, rebuild, or replace the insured property lost or damaged, on giving written notice of its intention to do so within thirty days after receiving the proof of loss.

Tenant shall keep the Premises in good order, repair and condition at all times during the Agreement term, except for ordinary wear and tear.
