Early Adjustments. Any Adjustment designated as an Early Adjustment in Section 6 of the Technical Provisions is anticipated to be completed by TxDOT prior to the deadline therefor set forth in Section 6.1.2.2 of the Technical Provisions. Developer's obligations to provide Protection in Place for Utilities includes Early Adjustments, whether or not timely completed. Developer shall coordinate with TxDOT and the Utility Owner as may be necessary for orderly completion of such Early Adjustment, and Developer shall conduct its Work without interfering with or hindering the progress or completion of such Early Adjustment. Subject to the provisions of this Section 7.5.10 but notwithstanding any contrary provision of the CDA Documents, the Work excludes all efforts necessary for completion of the Early Adjustments.

Early Adjustments. At Developer’s request, TxDOT may, in its sole discretion, accomplish early Adjustment Work through a direct contract with the utility company to coordinate Adjustment Work that would progress the Project. If any Work is performed by TxDOT, an adjustment to the DB Contractor’s price may be required.
