Any improvements to be constructed in connection with the Easement Purpose are referred to herein as "Improvements" and shall be constructed, located, configured and maintained by Grantee in strict accordance with the terms of this Easement Agreement and the C&M Agreement.

Easement Purpose. The "Easement Purpose" shall be for the purposes set forth in the Overpass Agreement. Any improvements to be constructed in connection with the Easement Purpose are referred to herein as "Improvements" and shall be constructed, located, configured and maintained by Grantee in strict accordance with the terms of this Easement Agreement and the Overpass Agreement.

The Easement shall not be used to access communications facilities operated by or for the benefit of parties other than the Grantees or the State of Colorado, such as third party private or non-profit telecommunications providers, broadcasters or similar entities or for access to any property other than the YVEA Property. To this end the conveyance includes all rights and privileges as are necessary or incidental to the reasonable and proper uses of the Easement for the purposes enumerated above. Nothing in this Agreement is intended or shall be construed to give the public any right of access across the Easement notwithstanding the fact that it is being granted to governmental entities.
