Easement premises definition

Easement premises means the geographic area designated in a forestry riparian easement, including the areas in which qualifying timber is located. Easement premises may be categorized as follows:

Easement premises as used herein shall mean certain space on a portion of the Mall Property as depicted on the site plan attached hereto as Exhibit C which is incorporated herein by reference. Easement premises includes: (i) the width and length location for said Skywalk Bridge within the east-west alley connecting X. 00xx xxx X. 00xx Xxxxxxx between P and Q Streets area necessary to construct, maintain, repair and replace said Skywalk Bridge between the Xxxxxxx Hotel and the Parking Garage; (ii) the width and length location as well as the vertical and lateral support structures within the Parking Garage; and (iii) the pedestrian vertical access between street level and the Skywalk Bridge within the Parking Garage (“Vertical Access Permanent Easement Area”). The Easement Premises is shown on Attachment A which is attached hereto and incorporated herein by this reference. Said Easement shall run with the land, Xxxxxxx Hotel Property, and Parking Garage for the benefit the Xxxxxxx Hotel Property and its successors and assigns. TO HAVE AND TO HOLD UNTO THE REDEVELOPER, its successors and assigns, so long as the Parking Garage is used as a parking garage and so long as the Skywalk Bridge shall be in existence, subject to early termination as provided below, together with the right of ingress and egress, for the purpose of designing constructing, reconstructing, inspecting, supporting, connecting, operating, maintaining, repairing and replacing the Skywalk Bridge and appurtenances thereto, located thereon, in whole or in part, at the will of Redeveloper, it being the intention of the parties hereto that City is hereby granting the uses herein specified without divesting City of title and ownership of the rights to use and enjoy the above described Parking Garage.
