ELECTRIC FENCE CERTIFICATE OF COMPLIANCE. The Parties record that the Property comprises vacant land and is not serviced by an electric fence and, as such, an Electric Fence System Certificate of Compliance issued by a registered electric fence installer in accordance with the provisions of the Electric Machinery Regulations of 2011 in terms of Government Regulation No.734 of 2009 (the “EFCC”) is not required.

ELECTRIC FENCE CERTIFICATE OF COMPLIANCE. 17.1 The SELLER hereby undertakes to furnish the PURCHASER, prior to occupation or transfer by the PURCHASER whichever is the earlier, a Certificate of Compliance in respect of the Electric Fence System, in terms of Regulation 12 of the Electrical Machinery Regulations, of the Occupational Health and Safety Act, (Act no 85 of 1993), issued by an electrical contractor who is registered in terms of the regulations. All costs incurred in obtaining such a certificate, including costs of any repairs or replacements required for the certificate to be issued, shall be borne by the SELLER. 17.2 An Electric Fence Certificate of Compliance issued at installation will be effective for the purposes of this clause. 17.3 The SELLER warrants that, as at date of occupation or transfer, whichever is the earlier; there will have been no addition or alteration to the electrical installations existing on the PROPERTY subsequent to the issue of such certificate. If there has been any addition and/or alteration, the SELLER shall be obliged to obtain a new Certificate of Compliance.
ELECTRIC FENCE CERTIFICATE OF COMPLIANCE. Regulation 12(4) of Electrical Machinery Regulations, 2011 to the Occupational Health and Safety Act of 1993 Applicable: Yes _____ No ____ The Seller shall, at own expense within 7 (seven) days after fulfilment of the suspensive conditions, but before occupation, deliver to the Transferring Attorney an Electric Fence Compliance Certificate issued by a qualified and registered person which shall certify that the installation, appliances as well as any alterations comply with the abovementioned Act and shall be without any exclusions or restrictions. The certificate shall cover the Electric Fence on the property or in the case of a sectional title unit on the common property. 11.4 Should the Seller fail to furnish any certificate of compliance, the Purchaser will be entitled to obtain the certificate, and, in that event, the Seller hereby authorizes the Conveyancer to deduct the cost of obtaining such certificate from the net proceeds and to reimburse the Purchaser.
ELECTRIC FENCE CERTIFICATE OF COMPLIANCE. If the property has a working live electric fence erected the seller shall obtain at his/her cost the required Certificate of Compliance in terms of the Occupational Health and Safety Act 85 of 1993. If the electric fence on the premises is faulty, the Seller shall at his/her cost repair the electric fence in order to deliver the required Certificate of Compliance to the Purchaser on or before the date of occupation referred to in Clause 8 above, or the date of registration of transfer of the Property into the Purchaser's name, whichever date is the earlier. The Seller undertakes not to make any alterations to the electric fence of the Property after the issue of the certificate.

  • Compliance Certification From time to time the Sub-Adviser shall provide such certifications with respect to Rule 38a-1 under the 1940 Act, as are reasonably requested by the Fund or the Manager. In addition, the Sub-Adviser will, from time to time, provide a written assessment of its compliance program in conformity with current industry standards that is reasonably acceptable to the Fund to enable the Fund to fulfill its obligations under Rule 38a-1 under the 1940 Act.

  • Compliance Certificate; Notice of Default (a) The Issuer shall deliver to the Trustee, within 90 days after the close of each fiscal year, an Officers’ Certificate stating that a review of the activities of the Issuer and its Subsidiaries has been made under the supervision of the signing Officers with a view to determining whether the Issuer and the Subsidiary Guarantors have kept, observed, performed and fulfilled their obligations under this Indenture and further stating, as to each such Officer signing such certificate, that to the best of such Officer’s knowledge, the Issuer and the Subsidiary Guarantors during such preceding fiscal year has kept, observed, performed and fulfilled each and every such covenant and no Default occurred during such year and at the date of such certificate there is no Default that has occurred and is continuing or, if such signers do know of such Default, the certificate shall specify such Default and what action, if any, the Issuer is taking or proposes to take with respect thereto. The Officers’ Certificate shall also notify the Trustee should the Issuer elect to change the manner in which it fixes the fiscal year end. (b) The Issuer shall deliver to the Trustee promptly and in any event within five days after the Issuer becomes aware of the occurrence of any Default an Officers’ Certificate specifying the Default and what action, if any, the Issuer is taking or proposes to take with respect thereto.

(b) So long as not contrary to the then current recommendations of the American Institute of Certified Public Accountants, the year-end financial statements delivered pursuant to Section 4.03(a) above shall be accompanied by a written statement of the Company's independent public accountants (who shall be a firm of established national reputation) that in making the examination necessary for certification of such financial statements, nothing has come to their attention that would lead them to believe that the Company has violated any provisions of Article 4 or Article 5 hereof or, if any such violation has occurred, specifying the nature and period of existence thereof, it being understood that such accountants shall not be liable directly or indirectly to any Person for any failure to obtain knowledge of any such violation. (c) The Company shall, so long as any of the Notes are outstanding, deliver to the Trustee, forthwith upon any Officer becoming aware of any Default or Event of Default, an Officers' Certificate specifying such Default or Event of Default and what action the Company is taking or proposes to take with respect thereto.

  • Officer’s Compliance Certificate At each time financial statements are delivered pursuant to Sections 7.1(a) or (b) and at such other times as the Administrative Agent shall reasonably request, an Officer’s Compliance Certificate.

  • Compliance Certificates The Company shall deliver to the Trustee, within 120 days after the end of each fiscal year during which any Securities of any series were outstanding, an officer’s certificate stating whether or not the signers know of any Event of Default that occurred during such fiscal year.   • Covenant Compliance Certificate The Borrower shall, contemporaneously with the furnishing of the financial statements pursuant to Section 8.8, deliver to the Bank a duly completed compliance certificate, dated the date of such financial statements and certified as true and correct by an appropriate officer of the Borrower, containing a computation of each of the financial covenants set forth in Section 10 and stating that the Borrower has not become aware of any Event of Default or Unmatured Event of Default that has occurred and is continuing or, if there is any such Event of Default or Unmatured Event of Default describing it and the steps, if any, being taken to cure it.
