Common use of Eligibility to Apply for New Position Clause in Contracts

Eligibility to Apply for New Position. A nurse who has filled a regular 17 position vacancy shall not be eligible to apply for a position in another unit for a 18 minimum of nine months following the conclusion of unit orientation, unless (1) the 19 nurse is oriented to the nursing unit to which the nurse is applying, (2) the nurse, the 20 Medical Center and the Association mutually agree to an earlier transfer application 21 date based upon unsuccessful performance, or (3) the nurse has filled a regular position 22 vacancy in the float pool unit, in which case the nurse shall not be eligible to apply for a 23 position in another unit for a minimum of twelve months, unless agreed otherwise 24 between the nurse and the Medical Center.
