Common use of Emergency Personnel Clause in Contracts

Emergency Personnel. A. It is understood that from time to time the Employer has a need to place emergency personnel on the payroll. Emergency personnel are those in pay status for no more than thirty (30) calendar days in any emergency situation. It is agreed that emergency personnel are not members of the bargaining unit and are therefore not covered under the terms of this Agreement. Further, it is agreed that the current 2 AAC 07.190 on Emergency Appointments shall continue in full force and effect. B. This Article shall not apply for emergency appointments to positions normally held by a bargaining unit member and the Employer agrees that emergency hires will not be made to circumvent the recruitment and examination process, to delay the return of seasonal bargaining unit members, or otherwise to displace a bargaining unit member. C. Emergency personnel as defined in this Article shall appear on the monthly personnel listings of all General Government bargaining unit members as provided for in this Agreement. Such listing shall designate by code which individuals are emergency personnel for the period of the listing.
