Common use of Emergency Work Assignment Clause in Contracts

Emergency Work Assignment. The parties to this Agreement recognize that if the College has been unsuccessful in obtaining Temporary Replacement Employees, College operations may require the assignment of work that necessitates Regular Part-Time Employees to perform work at another campus, which is not the employee's regularly assigned workplace due to emergency circumstances beyond the College's reasonable control. When the College has given notice of such an emergency work assignment, the College shall take into consideration the legitimate requests of employees to be excused where the performance of such an assignment would cause undue hardship or serious inconvenience. If the emergency work assignment is in excess of forty (40) kilometres from the employee's regularly assigned work location, the employee shall have the right to refuse such assignment. Transfers When a College determines that an employee is to be permanently transferred between campuses, it will give the employee at least three (3) weeks notice of the transfer. This Article will not apply where transfers are made pursuant to the layoff procedures. In such circumstances, the applicable layoff process will apply. An employee will only be transferred to a work location more than eighty (80) kilometres distant from the employee's previous work location if the employee agrees.
