JOB POSTINGS & PROMOTIONS.
.01 To encourage motivation, promote morale and create incentive, employees will be given first opportunity of a new or a vacant continuing or sessional position of sixty (60) days or longer.
(a) Such an employee, including an employee on layoff, may apply in confidence, for positions posted in accordance with Article 13 by applying during the seven (7) day posting period.
(b) Skill, ability and qualifications to perform the requirements of the position shall be the determining factor in job postings, except where the skill, ability and qualifications of employee applicants are relatively equal, in which case Seniority shall determine the successful employee applicant.
(c) A Sessional employee who is applying to a Continuing position in the same classification must successfully complete the interview and testing process and then the position will be awarded to the Sessional employee who has the most seniority. The disciplinary record of an employee will be considered by the Employer when awarding the position.
(d) If there is no employee applicant with the skill, ability and qualifications to perform the requirements of the position, UWO may fill the position from any source.
(e) It is understood that should a temporary vacancy become permanent it will be posted again as a permanent position.
.02 For members who are successful in promotion to a higher job classification, their new compensation rate shall be a minimum of 5% increase. The member’s new compensation rate will be that rate next above this 5% calculation in the salary grid for the new job classification. In no case will the new compensation rate be greater than the maximum rate for the Member’s new job classification.
.03 The Employer may return a member promoted under .02 above, or to a position in management, office or other classification, to his/her former classification at any time after a minimum of 30 days to a maximum of 90 days if the employer considers that the member is unable to perform the work. Seniority of the returning member, for the purposes of lay-off, recall and posting will be adjusted by the time spent out of the bargaining unit. Any other appointment made as a result of the promotion will be reversed.
.04 All unsuccessful members who have applied for a position will be notified of the following:
(a) the status of their application and,
(b) that a meeting may be arranged to discuss and receive feedback regarding their status in the competition and any general career or pe...

(a) Employees in the bargaining unit applying for such openings will submit an application in the prescribed format and be given an interview whenever the contents of this application warrant.
.02 The Employer may return a promoted employee to his/her former classification at any time within a three month period or an extended time period that is mutually agreed to, if the Employer considers that the employee is unable to perform the work. Any other appointment made as a result of the promotion will be reversed.
.03 In all cases of promotion to another position within the bargaining unit, where the qualifications of the candidate are deemed adequate to perform the work in question, and skill, knowledge, experience, and general fitness are assessed to be equal by the interviewing team, seniority shall govern.
.04 The Employer may return an employee promoted under .03 above, or to a position in management, office or other classification with the Employer, to his/her former classification at any time within a six month period. The affected employee has the

JOB POSTINGS & PROMOTIONS. 18.1 All vacancies for job classifications listed in Article 2 of this Agreement shall be posted after the Employer determines that a vacancy exists. Employees shall have five (5) working days beginning at 12:00 NOON on DAY 1 of the posting through 12:00 NOON on DAY 5 of the posting period to complete the application process for such vacancies.
18.2 All internal postings will be transmitted to all posting areas via computer and the date and time of posting as well as closing date will be stated on each posting.

JOB POSTINGS & PROMOTIONS. 12:01 When the Employer creates a new position, or when a vacancy occurs within CUPE Local 4358-02, which the employer intends to fill, a notice shall be posted at each site for fourteen (14) calendar days. Such posting shall commence not later than ten (10) business days following the determination that a permanent vacancy exists which the Employer intends to fill. However, vacancies arising from normal retirement shall be posted sixty (60) days prior to the employee’s normal retirement date. Nothing herein prevents the Employer from simultaneously advertising the position for candidates outside the Bargaining Unit. It is, however, understood that internal applicants shall be fully processed prior to external applicants being considered. For clarity purposes: “Fully processed” is understood to mean that the Employer has completed all internal interviews where applicable and has concluded that no internal candidate meets the requirement prior to interviewing external candidates.
12:02 The posting shall stipulate the job title, work location, qualifications, hours of work and wage rate, and a copy shall be provided to the Union. Such qualifications shall be those necessary to perform the job functions and shall not be established in an unreasonable manner.
12:03 In making staff changes, transfers, or promotions, appointment shall be made of the applicant with skills, abilities, and qualifications able to meet the normal requirements of the job. Where skills, abilities, and qualifications have been assessed by the Employer to be relatively equal, seniority shall govern. Appointments from within the Bargaining Unit shall be made within eight weeks of posting or as soon as is practicable.
12:04 The Employer will first consider applicants who are in CUPE Local 4358-02, then secondly applicants from Local 4358-03. After the above applicants have been fully processed, then any external applicant will be considered. It is understood that an external candidate will only be considered if there is no internal applicant who has the skills, ability and qualifications to do the work.
JOB POSTINGS & PROMOTIONS. 15.01 The Employer agrees to make each Bargaining Unit Employee aware of all job vacancies including and below the rank of Residential Supervisor by means of written postings, or if timely necessary - by phone.
(i) The Employer agrees to post notices in all work sites, of all Permanent, Temporary and Contract job vacancies for the positions including and below the rank of Residential Supervisor.
(ii) The Employer will provide an additional copy of the job posting to the Union President or his/her designate, at the time of posting.
(iii) The Employer will include on the job posting the job location and reference to the job description in the relevant section of the Employer's Policy and Procedures manual.
(iv) Employees wishing to be considered for such vacancies shall make written applications within seven (7) calendar days of the posting to the Head Office, or as outlined in the posting. The exception to this will be for postings for the positions of Part Time Night workers, Contract One-to-One workers and Full Time Night workers, where the applicant will make a written application within three (3) calendar days of the job opportunity being posted. Postings will be made available each Thursday prior to the posting date for distribution to the work sites.
15.02 In cases of promotions and transfers, between positions covered by the Bargaining Unit, seniority shall prevail provided that, in the opinion of the Employer, the ability, experience and qualifications of the Employees are equal.
15.03 If an Employee disputes the need for transfer, just cause must be given by the Employer.
15.04 Any Employee desirous of full-time employment in a position below the rank of Intake Coordinator and/or Program Co-ordinator shall advise the Head Office in writing. The Head Office will retain such requests on file for a period of six (6) months. The Employer will consider any valid request should a vacancy arise.
15.05 An Employee having completed the initial six (6) month probationary period and having changed job assignments will be subject to an additional six (6) month trial period. However, if the Employee fails to meet the Employer’s standards for the new assignment, or if the Employer chooses to return the Employee to his/her previously held position, the Employee’s previous position will be restored with no loss of seniority. In such case, where just cause is given, the Employee does not have recourse to the grievance or arbitration process of this Agreement.

The Employer may return an employee promoted under above, or to a position in management, office or other classification, to his former classification at any time within a four month period if the Employer considers that the employee is unable to perform the work. Any other appointment made as a result of the promotion will be reversed.

JOB POSTINGS & PROMOTIONS. .01 To encourage motivation, promote morale and create incentive, employees, sessionals or part-time employees within the bargaining unit will be given first opportunity of a new or a vacant position of greater than 3 month’s duration or regularly scheduled part-time employee position in the unit provided such employees, sessionals or part-time employees are qualified and capable of performing the responsibilities required in the job description.
(a) Employees, sessionals or part-time employees in the bargaining unit, including those on lay-off, applying for such openings will submit an application on the prescribed form.
.02 In all cases of promotion to another position within the bargaining unit, where the skill, knowledge, experience, and general fitness are assessed to be relatively equal by the interviewing team, seniority shall govern as follows. In all cases of promotion, a part-time employee with 1040 hours seniority, or an employee or sessional, seniority within the employee designation (as expressed in Article 4.03, .04 and .06) of the new position shall govern.
.03 The Employer may return a member promoted under .02 above, or to a position in management, office or other classification, to his/her former classification and employee designation at any time within a six month period if the Employer considers that the employee, sessional or part-time employee is unable to perform the work. Any other appointment made as a result of the promotion will be reversed. Seniority of the returning employee, sessional or part-time employee for the purpose of lay-off, recall and posting will be adjusted by the time spent out of the bargaining unit.
.04 When a posted position has not been filled after 20 working days of the posting expiry date all internal applicants will be notified as to the status of the posting.
