Employee Fraud. Client is solely responsible for making the Plan whole if fraud is committed against the Plan by Plan Participants or Client’s employees. Benefitfocus shall not be responsible for pursuing or correcting any such actions.

Employee Fraud. In the event of employee fraud against the plan, it is the employer’s responsibility to make the plan whole and pursue appropriate remedies from the employee.
