Common use of Employee Processed Grievances Clause in Contracts

Employee Processed Grievances. 12.4.1 An employee covered by this Agreement may present a grievance directly, and have such grievance resolved without intervention by CSEA provided that the resolution is consistent with the terms and provisions of this Agreement. CSEA shall be provided with copies of any grievance filed directly by employees and any responses by the District. Prior to resolution of any grievance, CSEA shall be given an opportunity to review the grievance documents and the proposed resolution. 12.4.2 CSEA shall have five (5) working days to file written objections to the proposed resolution if it believes the resolution is inconsistent with the terms and provisions of this Agreement. These objections shall be filed with the Superintendent. The Superintendent shall have five (5) working days to respond to CSEA’s written objections. If CSEA believes that the Superintendent’s response is still inconsistent with the terms and provisions of this Agreement, it may file a grievance directly to Step 4 on the issue(s) within five (5) working days from the response, or from the date of the response should have been received.
