Employee Rights After Leave. A) When an employee returns from a leave of six (6) months or less, the Employer shall return the employee to the same position in the same classification in which the employee was incumbent prior to the leave, seniority permitting. If the employee does not have the seniority, the layoff provisions shall apply.

When an employee returns from a leave of absence of six (6) months or less, or authorized extension thereof under Personnel Rule 303.140, or other leaves permitted by this Agreement, the Employer shall return the employee to the same or similar position in the same position classification in which the employee was incumbent prior to the commencement of such leave, seniority permitting. If the employee does not have the seniority, the layoff provisions of this Agreement shall apply.
