Employees Assistance Program (EAP. A. The Employer shall continue to maintain the MCFRS Employee Assistance Program for bargaining unit employees that was established through prior negotiations and shall assume the full cost of the program. Bargaining unit employees shall continue to be eligible to participate in the County’s Employee Assistance Program (EAP). All communications between employees and therapists of either the MCFRS EAP or the County’s EAP are confidential. B. All notes, records or tapes regarding interviews, evaluations or treatment provided by the MCFRS EAP to a bargaining unit employee shall not be communicated or released without the express written permission of the employee or his/her authorized representative, unless disclosure is otherwise authorized by law. C. All notes, records or tapes regarding interviews, evaluations or treatment provided by the County’s EAP to a bargaining unit employee will be held in confidence, to the extent the County can control the actions of the County’s EAP, unless disclosure is otherwise authorized by law.
