Entry into operation. With regard to the II Phase Binding Project Proposal, approved by ARERA with Resolution 438/2023/R/gas, the capacities provided for in the II Phase Binding Project Proposal under Offer Levels 1A (35.3 MSmcc/d), 1B (37.1 MSmc/d), 1C (41.2 MSmc/d) and 2 (43 MSmc/d) do not require any infrastructure intervention as they are already available. Therefore, the date on which the transportation capacity is made available depends on the availability of capacity on the other side of the IP and it is estimated (subject to further details below) that the transportation capacity is made available by the estimated date of entry into operation (“Availability Date") for each Offer Level in accordance with Annex 2A. With regard to the capacities envisaged in the II Phase Binding Project Proposal under Offer Level 3 (53.5 MSmc/d), on the contrary, infrastructure interventions are required as described in paragraph A.2.2, while the relevant availability of transportation capacity is estimated (subject to the following provisions) to be made available within the estimated date of entry into operation ("Availability Date") for Offer Level 3 in accordance with Annex 2A. Following the countersigning of this Agreement, Snam Rete Gas shall promptly send a communication in which, taking into account the transmission of all the Transportation Agreements by the assignees, it shall specify whether the capacities of each capacity booking request indicated in the same Agreement shall be made available as part of Offer Level 1A, Offer Level 1B, Offer Level 1C, Offer Level 2 and Offer Level 3. The User may request to update the Availability Date of their delivery as defined in this Agreement, if both of the following conditions are met: the Availability Date indicated in the update request must not be later than the date of operation estimated by the neighbouring TSO (i.e. TAP) ('TAP Estimated Date of Operation') on the other side of the IP; and the Availability Date indicated in the update request may in no case be later than 39 months from the Availability Date as set out in Annex 2A for Offer Level 1A and 42 months for Offer Level 1B, Offer Level 1C, Offer Level 2 and Offer Level 3. After the periods indicated in Section 4.2, the Availability Date may not be further postponed.

Entry into operation. With regard to the Project Proposal, approved by the Regulatory Authority for Energy, Networks and the Environment with resolution XXXX, the capacities forseen by the Project Proposal referred to in Offer levels 1 (30.8 msmc / d) and 2 (42.7 msmc / d ) do not require any infrastructural intervention as they are already available, whereas with reference to offer level 3 (52.1 msmc / d) the availability of the transport capacity is estimated at approximately 70 (seventy) months from the date of subscription of the Contract. Therefore, it is expected that - without prejudice to what is better specified below - the transportation capacity will be made available by 1 July 2027 ("Provision Date"). The Provision Date may be modified on the basis of the following provisions of this article, but in any case, with the exception of the provisions of paragraph 4.13 below, it cannot be after 1 July 2029 ("Upper Limit"). Without prejudice to Snam Rete Gas's right to invoke Force Majeure (according to the cases defined in Chapter 19, paragraph 4 of the Network Code), based on its discretion and acting as a reasonable and prudent operator, if factors unrelated to its reasonable control which will result in a longer duration of the construction works, including particular construction conditions that may be imposed or in any case become necessary (by way of example and not limited to the construction site by cluster and stable protection of the law enforcement, or other construction conditions that could arise during construction or any other need that may arise in consideration of the current Covid pandemic 19), Snam Rete Gas may postpone the Provision Date based on the following mechanism. Starting from the Contract signing date the and on an annual basis, Snam Rete Gas must: Confirm the Provision Date of 1 July 2027; or communicate to the Shipper, as well as to the other parties who have booked capacity at the Entry Point in the context of the Incremental Capacity Process (the "Incremental Users"), a new Provision Date which must fall after the last Provision Date communicated and in any case no later than 1 July 2029. The User - within 30 days of receiving the aforementioned communication or, failing that, within thirty days of the deadline for sending it - may in turn request, in agreement with all the other Incremental Users, that this Provision Date is further postponed, provided that the new date does not exceed the Upper Limit.
