Environmental Risk. The Builder makes no warranties, express or implied, about the existing or future health hazards or environmental conditions on the Property, in the Improvements, or from adjacent sources, including, but not limited to, exposure to radon gas, electric and magnetic fields, shifting or instability of the soil and contamination of the Improvements or the surrounding air, water or soil from any sources or in any manner. Buyer is advised that the continued presence of moisture on components of the Improvements can cause the propagation of mold that may cause allergenic reactions and other health problems in some individuals. Upon assuming possession of the Improvements, Buyer is responsible for implementing an inspection and maintenance program for the identification and elimination of moisture in the Improvements that could give rise to the growth of mold or other conditions detrimental to functioning of the Improvements or the health of its occupants. Any leak or the presence of moisture that is covered by the Builder’s Express Limited Home Warranty will be corrected pursuant to that Express Limited Home Warranty, but the Buyer’s failure to implement an effective maintenance program or the failure to promptly notify the Builder of warranty claims will negate the Builder’s responsibility (if any) for any property damage, personal injury, or other loss, damage or liability resulting directly or indirectly from the presence of mold or other harmful organisms.

Environmental Risk. Seller does not warrant any building materials used in the Property to be free from toxicity to occupants or users and therefore disclaims any liability arising therefrom. Seller is not responsible for personal allergic, health reactions, injury or property damage arising from environmental or ecological conditions present at the Property or from their prior use. Upon occupying the Home, the Owner is responsible for implementing an inspection and maintenance program for the identification elimination of moisture the Home that could give rise to the growth of mold or other conditions detrimental to the function the Home or the health of its occupants. Any leak or the presence of moisture that is covered by the Builders limited warranty will be addressed under the warranty, but the Owner’s failure to implement an effective maintenance program or the failure to promptly notify the Builder of Warranty Claims will negate the Builders responsibilities (if any) for any Property damage, personal injuries, or other Loss, damage or liability resulting directly or indirectly from the presence of mold or other harmful organisms.

Environmental Risk. Description: This task shall include information for the DOT to evaluate whether the project is reasonably expected to begin construction in a timely manner in reference to required approvals and permits from NEPA. Xxxxxx & Xxxx will be partnering with Impact 7G to provide the required information for the Environmental Risk requirements including the following. • Providing a detailed project schedule that identifies all major project milestones including state, local and federal agency approvals. • Providing a list of required approvals including environmental permits, reviews and studies required. • IM7G will complete the preliminary NEPA items for the project but does not include any intensive field work. • Draft purpose and need statement and description of proposed action and alternatives as well as Phase 1A archaeological investigation along with other environmental resource characterization in the corridor. • The work product would be a baseline resource document to be used to assist with NEPA classification and allow a more expedited NEPA process once federal funding is available. • Assessment of project risks and mitigation strategies for possible risks.
Environmental Risk. If there are any facts or conditions identified in a phase one assessment or in any other reports or other documents disclosed by ICNB or otherwise obtained by Acquirer that Acquirer reasonably believes could pose a current or future risk of material liability to ICNB or Acquirer (“Environment Risk”), then Acquirer shall identify the Environmental Risk to ICNB, identify the facts or conditions underlying that risk, and provide ICNB with a copy of the phase one assessment or other reports or documents relating to the Environmental Risk unless already in the possession of ICNB.
