EVENT REPORTING AND ABUSE/ NEGLECT/ EXPLOITATION a. Provider shall use best efforts to ensure that Member(s) are not abused, neglected or exploited while in its care.
b. The Provider shall report all events or instances involving abuse, neglect or exploitation of Members as required by Controlling Authority.
c. The Provider shall not use restrictive interventions except as specifically permitted by the individual Member’s treatment/habilitation plan or on an emergency basis in accordance with 10A NCAC 27E.
d. Provider shall timely report and comply with applicable Member incident, critical incident and death reporting Laws, regulations and policies and event reporting requirements of Provider’s and Alliance’s national accreditation organizations. Incidents shall be reported in the manner prescribed and on a form provided by the Secretary of the DHHS. Specifically, Providers are required to report Level II and Level III incidents, as those terms are defined at 10A NCAC 27G .0602, in the NC Incident Response Improvement System.
e. Alliance shall have the right to conduct its own investigation of any events reported to determine whether any claims were paid in error and to ensure compliance with Controlling Authority by the Provider. The Provider shall cooperate fully with all such investigative efforts. Alliance will provide the Provider a written summary of its findings within thirty (30) days. During such an investigation, if any issues are cited as out of compliance with this Contract or applicable federal or state Laws, rules or regulations, the Provider may be required to document and implement a plan of correction. Provider may request reconsideration of a determination that claims were paid in error as outlined in the Provider Manual.

During such an investigation, if any issues are cited as out of compliance with this Contract or federal or state laws, rules or regulations, the Contractor may be required to document and implement a plan of correction. Contractor may contest and appeal a determination that claims were paid in error as outlined in the LME/PIHP Provider Manual promulgated by LME/PIHP pursuant to N.C. Gen. Stat. §122C-151.3.

The CONTRACTOR shall cooperate with all such investigative requests. Failure to cooperate is a material breach of this contract. The LME/PIHP will provide the CONTRACTOR a written summary of its findings within 30 days. During such an investigation, if any issues are cited as out of compliance with this Contract or federal or state laws, rules or regulations, the CONTRACTOR may be required to document and implement a plan of correction. CONTRACTOR may contest and appeal a determination that claims were paid in error as outlined in the LME/PIHP Provider Operations Manual promulgated by the LME/PIHP pursuant to N.C. Gen. Stat. §122C-151.3 and Chapters 108C and 150B of the North Carolina General Statutes.

C. Contractor shall not use restrictive interventions except as specifically permitted by the Member’s individual treatment/habilitation plan or on an emergency basis in accordance with 10A NCAC 27E, 10A NCAC 13B, or as otherwise authorized in applicable Controlling Authority.
D. BH I/DD Tailored Plan shall have the right to conduct its own investigation of any event reported to determine whether any claims were paid in error or to ensure compliance with practice guidelines by the Contractor. The Contractor shall cooperate with all such investigative requests. Failure to cooperate is a material breach of this Contract. The BH I/DD Tailored Plan will provide the Contractor a written summary of its findings within timeframes established by BH I/DD Tailored Plan. During such an investigation, if any issues are cited as out of compliance with this Contract or federal or state laws, rules or regulations, the Contractor may be required to document and implement a plan of correction. Contractor may contest and appeal a determination that claims were paid in error as outlined in the BH I/DD Tailored Plan Provider Manual or as otherwise set forth in Controlling Authority.
