Exclusion from Limitation. Neither party's liability: (a) for death or personal injury caused by its negligence; (b) for breach of any condition as to title or quiet enjoyment implied by section 12 Sale of Goods Act 1979 or section 2 Supply of Goods and Services Act 1982; (c) for fraud or fraudulent misrepresentation; (d) for breach of Section 8 (Confidentiality); (e) Customer’s liability arising under Section 2.2 ( Restrictions); or (f) for any other liability that cannot be excluded or limited under English law; is excluded or limited by this Agreement.
