Eligibility Exclusions. Subject to Clause 2.5 of this Schedule 1, an individual is not eligible for training subsidised through the Skills First Program under this VET Funding Contract if the individual is: a student enrolled in a school (excluding a school based Apprentice/Trainee). This includes: any government, non-government, independent or Catholic school; or a student registered for home schooling in Victoria. Government schools are responsible for funding these opportunities for VET within the school curriculum through their Student Resource Package (SRP) allocation, including targeted VET in schools funding. Non-government schools make similar decisions for students on the basis of the resources available to them; within the meaning of the Corrections Act 1986 (Vic), a prisoner held at a prison, including: Xxxxxxx Correctional Centre (Ararat); Barwon Prison; Beechworth Correctional Centre; Dame Xxxxxxx Xxxxx Centre; Dhurringile Prison; Langi Kal Kal Prison; Loddon Prison Precinct; Marngoneet Correctional Centre; Tarrengower Prison; Metropolitan Remand Centre; Melbourne Assessment Prison; Fulham Correctional Centre; Port Xxxxxxx Prison; or Karrenga Annex; a person who is detained under the Mental Health Act 2014 (Vic), or the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997 (Vic) or the Sentencing Act 1991 (Vic) at the Xxxxxx Xxxxxxx Hospital; or a person who is detained (other than on weekend detention) under the Children, Youth and Families Act 2005 (Vic) or the Sentencing Act 1991 (Vic) or who is held on remand in one or more of the following youth justice facilities: Malmsbury Youth Justice Centre; Parkville Youth Residential Centre; or Melbourne Youth Justice Centre. The exclusions described in Clauses 2.4(b), (c) and (d) of this Schedule 1 do not apply to: young people on community based orders made under the Children, Youth and Families Act 2005 (Vic); or individuals held in Xxxx Xxxxxxx Transition Centre, who, subject to otherwise complying with the requirements in this Clause 2, may be eligible for training subsidised through the Skills First Program as they are able to physically access training outside of a custodial setting without supervision.

Eligibility Exclusions. Notwithstanding the criteria outlined in this section or in Table A, the following individuals are excluded from this demonstration. Payments or expenditures related to uncompensated care for such individuals as defined in STC 54, and for DSHP as described in STC 58, however, may be included as allowable expenditures under the Safety Net Care Pool (SNCP). In addition, SUD services described in STC 40 provided to MassHealth eligible individuals age 65 and over as well as benefits provided to recipients of state veteran annuities, regardless of age, described in the expenditure authority, may be included as an allowable expenditure under the demonstration. Individuals 65 years and older, to the extent that such an exclusion is authorized by MGL Ch118E Sec 9A, except for individuals eligible in accordance within 42 CFR 435.110 Participants in Program of All-Inclusive Care of the Elderly (PACE), except as otherwise described at STC 20(a) Refugees served through the Refugee Resettlement Program Enrollment Caps. The Commonwealth is authorized to impose enrollment caps on populations made eligible solely through the demonstration, except that enrollment caps may not be imposed for the demonstration expansion population groups listed as “Hypotheticals” in Table A. Setting and implementing specific caps are considered amendments to the demonstration and must be made consistent with section III, STC 7. Twelve Month Continuous Eligibility for Student Health Insurance Program Population. Individuals who are enrolled in a cost-effective Student Health Insurance Program will be continuously eligible for a period of up to 12 months while enrolled in the SHIP plan, until the end of the policy year date. The policy year will end on either July 31 or August 31 of each year. The Commonwealth will determine the individual’s eligibility at the completion of each policy year to ensure that the individual remains eligible.

Eligibility Exclusions. The following persons shall not be eligible to participate in the managed care component of the HealthChoice demonstration, and will receive benefits unaffected by the state demonstration unless otherwise indicated.
a. Individuals with dual Medicare/Medicaid coverage except those participating in the REM Program pursuant to STC 22.
b. Individuals over 65 years old.
c. Individuals determined Medically Needy under a spend-down.
d. Individuals expected to be continuously institutionalized for more than ninety (90) successive days in a long-term care or skilled nursing facility except individuals transitioning to community placement under the ICS program.
e. Beneficiaries enrolled in the Home Care for Disabled Children under a Model Waiver.
f. Individuals expected to be continuously institutionalized for more than thirty (30) successive days in a Psychiatric Institution for Mental Disease (IMD) (this includes only psychiatric diagnoses, not SUD diagnoses that would be eligible under the SUD component of the demonstration).
g. Beneficiaries enrolled in the Breast and Cervical Cancer Treatment Program (BCCTP) until December 31, 2013. Beginning January 1, 2014 this population will be covered through the demonstration as described in STC 19.
h. Employed Individuals with Disabilities (EID) participants as of October 1, 2008.
i. Certain xxxxxx care groups:
i. A child receiving an adoption subsidy who is covered under the parent’s private insurance;
ii. A child under State supervision receiving an adoption subsidy who lives outside the state; and
iii. A child under State supervision who is in an out-of-state placement.
Eligibility Exclusions. Eligibility under this grievance procedure is limited to all full- time, non-probationary employees. The right of grievance shall in no way be construed to diminish management rights of the City as set forth in Article 9 including, without limitation, the decision of the Chief or supervisors to allow or disallow an employee’s request for paid leaves. Performance evaluations are not subject to the grievance process.
Eligibility Exclusions. Generally, a person who has access to group health insurance is not eligible for IowaCare. However, a person with access to group health insurance may enroll in IowaCare, if the individual states that any of the following conditions exist:
a. The coverage is unaffordable;
b. Exclusions for preexisting conditions apply;
c. Needed services are not services covered by the plan;
d. The limits of benefits under the plan have been reached; or,
e. The plan includes only catastrophic health care coverage.
