Failure to attend a meeting Sample Clauses

Failure to attend a meeting. If the debtor fails to comply with any request of the agent’s to attend a meeting, the agent should report to the sheriff in terms of section 64(2) of the Act for a court order compelling his appearance. Once an Order is obtained this must be served on the debtor by Sheriff Officers. It is important that the Order is served on the debtor personally rather than leaving this with an associate or posting it through the letterbox. However, if personal service of the order is not possible, it should be posted through the letterbox as normal (see 11.5). In the event of continued non-co-operation, the debtor will have committed an offence. A suspected offence report should only be completed if the debtor has been personally served the Order, or the Sheriff Officers have confirmed they are content the debtor was at the address they visited.
