Fingerprinting of Contractor. If BUSD determines, in its sole discretion, that services performed hereunder will involve contact with BUSD pupils, the Contractor shall comply with the provisions of Education Code section 45125.1 and California Assembly Bill 346 regarding the submission of employee fingerprints to the California Department of Justice and the FBI, and the completion of criminal background investigations of its employees. (For Fingerprint Waiver Request and Approval see Attachment B) TB Testing. Contractor and all regular and substitute employees shall provide verification of having been tested for tuberculosis and cleared to work with minors as evidenced by a state licensed medical doctor's signature prior to any of the Contractor's employees, or those of any other contractors, coming into contact with the BUSD's pupils. Contractor shall keep proof of negative TB testing on file. Incorporation Exhibits: Each exhibit attached hereto is hereby incorporated herein by reference. Contractor agrees that to the extent any document incorporated herein conflicts with any term or provision of Agreement, the terms and provisions of this Agreement shall govern.

Fingerprinting of Contractor. In the event that this Agreement may involve contact with BUSD pupils, the Contractor shall comply with the provisions of Education Code section 45125.1 and California Assembly Bill 346 regarding the submission of employee fingerprints to the California Department of Justice and the FBI, and the completion of criminal background investigations of its employees. (For Fingerprint Waiver Request and Approval see Attachment B) Independent Contractor Status: Contractor attests that he/she is engaged in a separately established bona fide business and is in fact an Independent Contractor in accordance with IRS and EDD requirements. Contractor understands and agrees that he/she and all of his/her employees shall not be considered officers, employees, agents, partners, or joint ventures of BUSD, and are not entitled to benefits of any kind or nature normally provided employees of BUSD and/or to which BUSD's employees are normally entitled, including, but not limited to, State Unemployment Compensation or Worker's Compensation.

Consultant shall keep a copy of said information in the employee file. Independent Contractor Status: Contractor attests that he/she is engaged in a separately established bona fide business and is in fact an Independent Contractor in accordance with IRS and EDD requirements.
