Fingerprinting Requirements. Contractor hereby acknowledges that, if applicable, it is required to comply with the requirements of Education Code Section 45125.1 with respect to fingerprinting of employees who may have contact with the District's students. The Contractor shall also ensure that its Contractors on the Project also comply with the requirements of Section 45125.1. If required by Education Code Section 45125.1, the Contractor must provide for the completion of a Fingerprint Certification form, in the District’s required format, prior to any of the Contractor's employees, or those of any other Contractors, coming into contact with the District's students. Contractor further acknowledges that other fingerprinting requirements may apply, as set forth in Education Code Section 45125 et seq., and will comply with any such requirements.

The Finger printing should be such that it can identify the unique STB number or the unique Viewing Card (VC) number. 4. The STB should support both visible and covert types of finger printing. Provided that only the STB deployed after 30.10.2019 shall support the covert finger printing. 3. The fingerprinting should not get invalidated by use of any device or software 4. The finger printing should not be removable by pressing any key on the remote of STB. 5. The Finger printing should be on the top most layer of the video. 6. The Finger printing should be such that it can identify the unique STB number or the unique Viewing Card (VC) number. 7. The Finger printing should appear on all the screens of the STB in all scenarios, such as menu, EPG, Settings, blank screen, and games etc. 8. The location, font colour, background colour of finger printing should be changeable from head end and should be random on the viewing device. 9. The Finger printing should be able to give the numbers of characters as to identify the unique STB and/ or the VC. 10. The Finger printing should be possible on global as well as on the individual STB basis. 11. The overt finger printing should be displayed by the IPTV Operator without any alteration with regard to the time, location, duration and frequency. 12. Scroll messaging should be only available in the lower part of the screen. 13. The STB should have a provision that finger printing is never disabled. 14. The watermarking network logo for all pay channels shall be inserted at encoder end only. Provided that only the encoders deployed after 30.10.2019 shall support the watermarking network logo for all pay channels at the encoder end.

Fingerprinting Requirements. 25.1 The District has determined under Education Code §45125.1, subdivision C, that in performing services pursuant to this Agreement, Consultant employees or subconsultant employees may have contact with pupils. As required under Education Code section 45125.1, subdivision (a), Consultant shall require their employees or subconsultant employees who will provide services pursuant to this Agreement to submit their fingerprints in a manner authorized by the Department of Justice (DOJ) together with a fee determined by the DOJ in order to conduct a criminal background check to determine whether such employees have been convicted of or have charges pending for a felony as defined under Education Code §45122.1. 25.2 Consultant shall not permit any employee or subconsultant’s employee to perform services who may come in contact with pupils under this Agreement until the DOJ has determined that the employee has not been convicted of a felony or has no criminal charges pending for a felony as defined in Education Code § 45122.1. 25.3 Consultant shall certify in writing to the governing board of the San Diego Unified School District, Facilities Management Department, 0000 Xxxxxxx Xxxxxx, San Diego, CA 92111, Attention: Xxxxxx Xxxxxxx, that all of its employees or subconsultant employees who may come in contact with pupils have not been convicted of or have no criminal charges pending for a felony, as defined in Education Code §45122.1. 25.4 In the event Consultant fails to comply with all of the requirements of Education Code section 45125.1 and injury results from such failure, Consultant shall defend, indemnify, protect and hold San Diego Unified School District and its agents, officers and employees harmless from and against any and all claims, demands, liability, judgments, awards, losses, injury, damages, expenses, charges or costs of any kind or character whether to the District or to any person or property which arise from or are connected with or are caused or claimed to be caused by Consultant’s failure to comply with the requirements contained in Education Code §45125.1, including, but not limited to, the requirement prohibiting Consultant from using employees or subconsultant employees who may have contact with pupils who have been convicted or have charges pending for a felony as defined in Education Code § 45122.1. 25.5 Any subconsultant hired by Consultant shall be subject to and shall comply with this provision. Fingerprinting Requirements. TES shall conduct such criminal background checks of all TES Personnel through the Department of Justice (“DOJ”) as required by applicable law and, upon receipt of DOJ clearance, certify to Client that no TES Personnel working with student/patient of Client have been convicted of a violent or serious felony (as defined by applicable law), are disqualified pursuant to 3319.39 or 3314.41 of the Ohio Revised Code, or are the subject of a criminal action pending upon charges of commission of a violent or serious felony (as defined by applicable law). The list of TES Personnel described in Section 7(a) above shall identify those TES Personnel who have been so cleared by DOJ.

Fingerprinting Requirements. Education Code Section 45125.1 states that if employees of any CONSULTANT providing school site Administrative or similar services may have any contact with any under age pupils (younger than 18 years of age); those employees shall be fingerprinted by the Department of Justice (DOJ) before entering to determine that they have not been convicted of a serious or violent felony. If the DISTRICT determines that more than limited contact with students will occur during the performance of these SERVICES by CONSULTANT, CONSULTANT will not perform SERVICES until all employees providing SERVICES have been fingerprinted by the DOJ and DOJ fingerprinting clearance certification has been provided to DISTRICT. a) DISTRICT has determined that CONSULTANT’S SERVICES (□ will/ □will not) result in contact with under age pupils. If contact will be made CONSULTANT will obtain fingerprinting clearance for all employees before SERVICES can begin and CONSULTANT will provide a list to the DISTRICT of All employees cleared by DOJ who will provide SERVICES under this AGREEMENT. Fingerprinting Requirements. A contractor, subcontractor or vendor, or any employee of contractor, subcontractor or vendor, or any employee of a contractor, subcontractor or vendor, who is contracted to provide services on a regular basis at an individual school, shall obtain a valid fingerprint clearance card pursuant to A.R.S. 41-1758 et seq. The Superintendent, or a principal subject to approval by the Superintendent, may exempt from the requirement to obtain a fingerprint clearance for a contractor, subcontractor, or vendor whom the Superintendent or principal has determined is not likely to have independent access to or unsupervised contact with students as part of their normal job duties while performing services to the school or to the School District. The exemption (on page 6) shall be given in writing and a copy filed in the District office.
