Fire consultant. The fire consultant is responsible for all the aspects of rational fire design and quality inspection. Without derogating from the generality thereof the fire consultant will perform the following specific functions and duties in respect of the rational fire design aspects of the works: 7.1 Give opinion on aspects of the works which are not in accordance with the agreement 7.2 Supply the specified number of drawings 7.3 Issue instructions if bills of quantities is to be used as specification 7.4 Receive and accept design documentation undertaken by 7.5 Issue instructions to the contractor regarding: 7.5.1 Alteration to design, quality or quantity of the works provided that such instructions shall not substantially change the scope of the works 7.5.2 Removal of any materials and goods from the site and the substitution of any materials and goods therefor 7.5.3 Removal or re-execution of any work 7.5.4 Opening up of work for inspection 7.5.5 Testing of work and materials and goods 7.5.6 Protection of the works Preliminaries 7.5.7 Making good physical loss and repairing damage to the works 7.5.8 Compliance with Acts of Parliament, regulations and bylaws 7.6 Provide the contractor with the necessary information to set out the 7.7 Acceptance of design by subcontractors 7.8 Inspect the works from time to time and give the contractor interpretation and guidance on the standard and state of completion required for practical completion 7.9 Inspect the works for practical completion 7.10 Issue the list for practical completion and re-inspect upon request of the contractor 7.11 Inspect the works at the end of the defects liability period 7.12 Issue the list for final completion and re-inspect upon request of the

  • Fire Control Purchaser shall, both independ- ently and in cooperation with Forest Service, take all rea- sonable and practicable action to prevent and suppress fires resulting from Purchaser’s Operations and to sup- press any forest fire on Sale Area. Purchaser’s independ- ent initial fire suppression action on such fires shall be immediate and shall include the use of all necessary per- sonnel and equipment at Purchaser’s disposal on Sale Area or within the distance of Sale Area stated in A13. B7.31 Purchaser’s Reinforcement Obligations. Whenever an Operations Fire or Negligent Fire, whether on or off Sale Area, or any other forest fire on Sale Area, has not been suppressed by initial action and appreciable reinforcement strength is required, Forest Service may require further actions by Purchaser until such fire is con- trolled and mopped up to a point of safety. Such actions may include any or all of the following as necessary to fight such fire: B7.311 Suspend Operations. To suspend any or all of Purchaser’s Operations. B7.312 Personnel. To release for employ- ment by Forest Service any or all of Purchaser’s person- nel engaged in Purchaser’s Operations or timber process- ing within the distance of Sale Area stated in A13. Any organized crew so hired shall include Purchaser’s super- visor, if any. Personnel so employed shall be paid at For- est Service standard emergency fire fighting rates. B7.313 Equipment. To make available for Forest Service rental at fire fighting equipment rates common in the area or at prior agreed rates any or all of Purchaser’s equipment suitable for fire fighting and cur- rently engaged in Purchaser’s Operations within the dis- tance of Sale Area stated in A13. Equipment shall be op- erated only by personnel approved by Purchaser, if so requested by Purchaser.

  • Entire Contract This Contract contains the entire Contract between the parties with respect to the matters herein, and there are no restrictions, promises, warranties or undertakings other than those set forth herein or referred to herein. No exceptions, alternatives, substitutes or revisions are valid or binding on County unless authorized by County in writing. Electronic acceptance of any additional terms, conditions or supplemental Contracts by any County employee or agent, including but not limited to installers of software, shall not be valid or binding on County unless accepted in writing by County’s Purchasing Agent or designee.

  • Project Management and Coordination The Engineer shall coordinate all subconsultant activity to include quality of and consistency of work and administration of the invoices and monthly progress reports. The Engineer shall coordinate with necessary local entities.

  • Services Covered 58.1 To the extent required by Applicable Law and subject to the terms and conditions of this Agreement, CLEC will interconnect its network with CenturyLink’s network for the transmission, routing and termination of Local Traffic, ISP-Bound Traffic, IntraLATA LEC Toll Traffic, Local and Toll VoIP- PSTN Traffic, Transit Traffic and Jointly Provided Switched Access Service Traffic. This Agreement is intended only for traffic consisting of wireline to wireline communications, not for Mobile Wireless Service traffic, and neither Party will route Mobile Wireless Service traffic to the other Party (other than Transit Traffic) without first executing a separate written agreement to govern such traffic. 58.1.1 This Article governs the Interconnection of network facilities of the Parties, and the transport, termination and billing of Local Traffic, ISP-Bound Traffic, IntraLATA LEC Toll Traffic, VoIP- PSTN Traffic and Transit Traffic between CenturyLink and CLEC. 58.1.2 The Parties shall use separate two-way Feature Group D trunks for the exchange of equal-access InterLATA Toll Traffic or IntraLATA Toll Traffic, (other than IntraLATA LEC Toll Traffic, Toll VoIP-PSTN or Jointly Provided Switched Access Traffic), and such trunks shall be ordered out of and subject to the applicable access Tariffs. As required by the applicable Tariff, any Local Traffic routed over Feature Group D trunks is subject to the applicable access Tariff and rates. 58.1.3 In the event CLEC routes any traffic to CenturyLink in violation of this Agreement, CenturyLink shall be entitled to seek injunctive relief and to recover damages, including without limitation, compensation for such traffic at access rates. 58.1.4 Each Party is solely responsible for the services it provides to its End Users and to other providers.

  • Integration; Entire Agreement This Warrant is intended by the parties as a final expression of their agreement and intended to be a complete and exclusive statement of the agreement and understanding of the parties hereto in respect of the subject matter contained herein. There are no restrictions, promises, warranties or undertakings, other than those set forth or referred to herein with respect to the registration rights granted by the Company with respect to the Warrants. This Warrant supersedes all prior agreements and understandings between the parties with respect to such subject matter (other than warrants previously issued by the Company to the Warrantholder).

  • Agreement is Entire Contract This Agreement constitutes the entire contract between the parties hereto with regard to the subject matter hereof. This Agreement is made pursuant to the provisions of the Plan and shall in all respects be construed in conformity with the terms of the Plan.

  • ENTIRE AGREEMENT, ETC The Loan Documents and any other documents executed in connection herewith or therewith express the entire understanding of the parties with respect to the transactions contemplated hereby. Neither this Agreement nor any term hereof may be changed, waived, discharged or terminated, except as provided in Section 27.
