Flight Display. (a) All Shared Code Segments will be included in the schedule, availability and fare displays of all computerized reservations systems in which Continental and Gulfstream participate, the Official Airline Guide (to the extent agreed upon) and Continental’s and Gulfstream’s internal reservation systems, under the shared code as well as the operator’s own code, to the extent possible. Continental and Gulfstream will take the appropriate measures necessary to ensure the display of the schedules of all Shared Code Segments in accordance with the preceding sentence. (b) Continental and Gulfstream will disclose and identify the Shared Code Segments to the public as actually being a flight of and operated by the operating carrier in at least the following ways: (i) a symbol will be used in timetables and computer reservation system indicating that Shared Code Segments are actually operated by the other carrier; (ii) to the extent reasonable, messages on airport flight information displays will identify the operator of flights shown as Shared Code Segments; (iii) Continental and Gulfstream advertising concerning Shared Code Segments and Continental and Gulfstream reservationists will disclose the operator of each flight; and (iv) in any other manner prescribed by law.

Flight Display. All Through Flights will be included in the availability and fare displays of all computerized reservations systems in which Frontier and Great Lakes participate, the OAG (to the extent agreed upon) and Frontier and Great Lakes internal reservation systems under the F9* designator code. Frontier and Great Lakes will take the appropriate measures necessary to ensure the display of Through Flights in accordance with the preceding sentence. (a) Frontier and Great Lakes will disclose and identify the Great Lakes flights utilizing the F9* designator code to the public as actually being flights of and operated by Great Lakes, in at least the following ways: (i) a symbol will be used in timetables and computer reservation systems indicating that F9* Flights are actually operated by Great Lakes; (ii) to the extent reasonable, messages on airport flight information displays will identify the operator of flights shown as F9* Flights; (iii) Frontier and Great Lakes advertising concerning F9* Flights and Frontier and Great Lakes reservationists will disclose the operator of each flight; and, (iv) in any other manner prescribed by law.
Flight Display. (a) All Code Shared Segments will be included in the schedule, availability and fare displays of all computerized reservations systems in which America West and Hawaiian participate, the Official Airline Guide (to the extent agreed upon) and America West’s and Hawaiian’s internal reservation systems, under the shared code as well as the operating carrier’s code. America West and Hawaiian will take commercially reasonable measures to ensure the display of the schedules of all Code Share Flights in accordance with the preceding sentence. America West shall have the obligation to inform the passenger booked to travel on Hawaiian of any special conditions applicable to travel on the aircraft of Hawaiian. (b) America West and Hawaiian will disclose and identify the flights operated as Code Shared Segments to the public as actually being a flight of and operated by the operating carrier, in at least the following ways: (i) a symbol will be used in timetables and computer reservation system indicating that the flights operated as Code Shared Segments are actually operated by Hawaiian; (ii) to the extent reasonable, messages on airport flight information displays will identify Hawaiian on Code Shared Segments; (iii) America West and Hawaiian advertising concerning Code Shared Segments and America West and Hawaiian reservations will disclose the operator of each flight; and (iv) in any other manner prescribed by law. (c) All flights displayed in the computer reservation system are subject to the conditions set forth on Exhibit E attached hereto.
Flight Display a. To the extent reasonably possible, American shall include AA Code Shared Segments in the availability and fare displays of all computerized reservations systems in which Hawaiian and American participate, the Official Airline Guide ("OAG"), American's timetables and American's internal reservation systems, using the AA designator codes. Hawaiian and American shall take all necessary measures to ensure the display of AA Code Shared Segments in accordance with the preceding sentence. American shall publish, to the extent permitted by governmental rules and regulations, AA Code Shared Segments in Airline Guides, CRSs and its own reservations system. Hawaiian shall supply AA with the necessary schedule information. A separate set of American flight numbers will be assigned for American designator AA Code Shared Segments. b. Hawaiian and American shall disclose and identify the AA Code Shared Segments to the public as actually being a flight of and operated by Hawaiian, in at least the following ways: i. a symbol will be used in timetables and computer reservation systems indicating that AA Code Shared Segments are actually operated by Hawaiian; ii. American advertising concerning AA Code Shared Segments and American reservationists will disclose the operator of each flight; and iii. in any other manner prescribed by law. c. American agrees to pay any costs incurred for the publication of the AA Code Shared Segments in the Airline Guides, CRSs and reservations systems, CRS vendor booking fees and transaction fees and Hawaiian agrees to allow normal Interline Service Charge and ticketing fees as outlined in paragraph 7.c. below.

All HA Code Shared Segments shall be included in the availability and fare displays of all computerized reservations systems in which Hawaiian and Reno participate, the Official Airline Guide ("OAG"), time tables of both Parties and Hawaiian's and Reno's internal reservation systems, using the HA designator, to the extent reasonably possible. Hawaiian and Reno shall take all necessary measures to ensure the display of HA Code Shared Segments in accordance with the preceding sentence. b. Hawaiian and Reno shall disclose and identify the HA Code Shared Segments to the public as actually being a flight of and operated by the operating Carrier, in at least the following ways: i. a symbol will be used in timetables and computer reservation systems indicating that HA Code Shared Segments are actually operated by Reno; ii. to the extent reasonable, messages on airport flight information displays will identify the operator of flights shown as HA Code Shared Segments unless otherwise stated in this document; iii. Hawaiian and Reno advertising concerning HA Code Shared Segments and Hawaiian and Reno reservationists will disclose the operator of each flight; and iv. in any other manner prescribed by law.
Flight Display. (a) All Through Flights will be included in the availability and fare displays of all computerized reservations systems in which CAL and SWA participate, the Official Airline Guide (to the extent agreed upon) and CAL's and SWA's internal reservation systems under the CAL designator code (CO or CO*) as well as, with respect to the CO* Flights, SWA's designator code, to the extent possible. CAL and SWA will take the (b) CAL and SWA will disclose and identify the CO* Flights utilizing the CO* designator code to the public as actually being flights of and operated by the operating party, in at least the following ways: (i) a symbol will be used in timetables and computer reservation system indicating that CO* Flights are actually operated by SWA; (ii) to the extent reasonable, messages on airport flight information displays will identify the operator of flights shown as CO* Flights; (iii) CAL and SWA advertising concerning CO* Flights and CAL and SWA reservationists will disclose the operator of each flight; and (iv) in any other manner prescribed by law.

  • Flight Crew (a) Lessor shall employ or engage and pay all salaries, benefits and and/or compensation for a fully-qualified flight crew with appropriate credentials to conduct each flight undertaken under this Agreement. Lessor may use temporary flight crewmembers for a flight under this Agreement only if any such temporary crewmember is FlightSafety (or SimuFlite) trained, is current on the Aircraft and satisfies all of the requirements and conditions under the insurance coverage for the Aircraft. All flight crewmembers shall be included on any insurance policies that Lessor is required to maintain hereunder. (b) The qualified flight crew provided by Lessor shall exercise all of its duties and responsibilities with regard to the safety of each flight conducted hereunder in accordance with applicable FAR’s. The Aircraft shall be operated under the standards and policies established by Lessor. Final authority to initiate or terminate each flight, and otherwise to decide all matters relating to the safety of any given flight or requested flight, shall rest with the pilot-in-command of that flight. The flight crew may, in its sole discretion, terminate any flight, refuse to commence any flight, or take any other action that, in the judgment of the pilot-in-command, is necessitated by considerations of safety. No such termination or refusal to commence by the pilot-in-command shall create or support any liability for loss, injury, damage or delay in favor of Lessee or any other person. Lessor shall not be liable to Lessee or any other person for loss, injury or damage occasioned by the delay or failure to furnish the Aircraft and flight crew pursuant to this Agreement for any reason.

  • RE-WEIGHING PRODUCT Deliveries are subject to re- weighing at the point of destination by the Authorized User. If shrinkage occurs which exceeds that normally allowable in the trade, the Authorized User shall have the option to require delivery of the difference in quantity or to reduce the payment accordingly.   • Loop Provisioning Involving Integrated Digital Loop Carriers 2.6.1 Where Xxxx has requested an Unbundled Loop and BellSouth uses IDLC systems to provide the local service to the End User and BellSouth has a suitable alternate facility available, BellSouth will make such alternative facilities available to Xxxx. If a suitable alternative facility is not available, then to the extent it is technically feasible, BellSouth will implement one of the following alternative arrangements for Xxxx (e.g. hairpinning): 1. Roll the circuit(s) from the IDLC to any spare copper that exists to the customer premises. 2. Roll the circuit(s) from the IDLC to an existing DLC that is not integrated. 3. If capacity exists, provide "side-door" porting through the switch. 4. If capacity exists, provide "Digital Access Cross Connect System (DACS)- door" porting (if the IDLC routes through a DACS prior to integration into the switch). 2.6.2 Arrangements 3 and 4 above require the use of a designed circuit. Therefore, non- designed Loops such as the SL1 voice grade and UCL-ND may not be ordered in these cases. 2.6.3 If no alternate facility is available, and upon request from Xxxx, and if agreed to by both Parties, BellSouth may utilize its Special Construction (SC) process to determine the additional costs required to provision facilities. Xxxx will then have the option of paying the one-time SC rates to place the Loop.

  • Designated Configuration; Trained Personnel State Street and the Fund shall be responsible for supplying, installing and maintaining the Designated Configuration at the Designated Locations. State Street and the Fund agree that each will engage or retain the services of trained personnel to enable both parties to perform their respective obligations under this Addendum. State Street agrees to use commercially reasonable efforts to maintain the System so that it remains serviceable, provided, however, that State Street does not guarantee or assure uninterrupted remote access use of the System.

  • How to Obtain Warranty Service The Warranty Holder must inspect the Flooring for Manufacturing Defects caused by improper milling, grading, staining, and coating, and report any such defects to Cali Bamboo, prior to installation of the Flooring. To obtain warranty service, the Warranty Holder must contact Cali Bamboo’s Customer Experience Department: xxxxxxxxxxxxxxx@xxxxxxxxxx.xxx/ 000- 000-0000. Warranty claims must be received within 30 calendar days after the Warranty Holder identifies the Manufacturing Defect or other basis for a warranty claim. To be covered under this Cali Bamboo limited warranty, the Warranty Holder must provide documentation of sales order and proof that the Flooring was properly installed in accordance with the Installation Guide (defined below). Cali Bamboo reserves the right to retain a certified and independent National Wood Flooring Association inspector (“NWFA Inspector”) to verify the Warranty Holder’s warranty claims. The determination of the NWFA Inspector regarding the warranty claim is not binding on either Cali Bamboo or on the Warranty Holder. A determination that does not verify the warranty claim shall not affect the Warranty Holder’s right to submit its claim to arbitration in accordance with the terms of the Arbitration Agreement (as defined in Cali Bamboo’s Terms and Conditions of Purchase). The performance of the inspection, however, if requested by Xxxx Xxxxxx and assuming that Xxxx Xxxxxx advances the full cost of the inspection as described above, is a requirement for the Warranty Holder to submit a warranty claim to arbitration under the Arbitration Agreement.
