Frequency Limitations. Regulation D limits certain types of withdrawal and transfer transactions you can make out of a savings and money market account. During any monthly statement cycle, you may not make more than six (6) withdrawals or transfers to another account of yours or to a third party by means of a preauthorized or automatic transfer, facsimile or telephone order or instruction, computer transfer, or by check, draft, or similar order to a third party. We will use the date a transaction is completed by us (as opposed to the day you initiate it) to apply the frequency limitation. If you exceed these limits, we may close the account, impose a fee and/or change the account to a non-interest bearing demand deposit account. Additional transaction limitations on your particular account may apply. Consumer account holders please refer to your Truth in Savings Disclosure applicable to the account you have selected. Frequency Limitations. You may make only five (5) cash withdrawals in any one day at our terminals and you may not make cash withdrawals that exceed your account balance. • You may make up to twenty (20) electronic fund transactions per day and, of those twenty (20) transactions, you may only make up to five (5) PIN generated electronic fund transactions per day. Dollar Amount Limitations • You may withdraw up to $500.00 cash within any 24 hour period. • When using your ATM card for point of sale transactions, you may not exceed $500.00 in transactions per day. This amount includes any ATM withdrawals made the same day. • You may withdraw up to $500.00 per day in combination with point-of-sale transactions. • You may not exceed $2,000.00 in transactions per day in combination with ATM withdrawals. • You may transfer up to the available balance in your account at the time of the transfer.
Frequency Limitations. Contact Legacy Ag Credit for limitations on the dollar amount and frequency of checks permitted to be submitted through the RPC Service. Payments in excess of these amounts may be declined and you may have to repay your Account via some other method, as set forth in your credit agreement. We may allow Payments that exceed the above limits based on a number of factors, such as your account activity history and the length of your relationship with us. However, if we choose to do so, we may at any time, without notice to you, increase or decrease that amount. • Cutoff Time. Any Payment submitted via the RPC Service must be received by us no later than 2:00 P.M. C.S.T. (the “Cut-Off Time”) to be posted to your Account on the same business day. If you submit a Payment on a weekend or holiday, the Payment will generally post to your Account on the next business day. We reserve the right to change the Cut-Off Time in our sole discretion. • Image Quality. We will reject any Image that fails to meet the image quality standards established from time to time by ANSI, any regulatory agency, or us in our sole discretion. • Declined Payments. We may, in our sole discretion, choose whether to accept or decline any Payment submitted through the RPC Service. Nothing I n these RPC T&Cs shall be construed to require us to accept any Payment submitted through the RPC Service. You agree that we will not be liable to you if we decline to process any Payment or reject any Image and that you will remain liable for any amounts owing on your Account.

The warranty claims that relate to defects caused by any of the following factors are not covered by the Contractual Warranty: • Improper Use or Non-compliance with installation, commissioning, operation or maintenance instructions (i.e. not according to the operation & installation manual) • Unauthorized modifications, changes or attempted repairs, • Vandalism, destruction through external influence and/or persons/animals • Use in an unsuitable environment, including any environment or location that causes excessive wear and tear or dirt or dust or debris buildup within the system or that is difficult or unsafe for Xantrex LLC representatives to access • Insufficient ventilation • Installation in a corrosive environment • Failure to observe applicable safety standards & regulations • Damages during transportation or storage • Force majeure, examples include, but not limited to: fire, flood, earthquakes, storm damage, overvoltage & lightning strikes • Exposure to fire, water, snow, moisture, or liquid ingress (except for any such exposure to environmental conditions that your Product was specifically designed to withstand as indicated in the applicable specifications for your Product) • Used as a component part of a product expressly warranted by another manufacturer • If the original identification (trade-mark, serial number) markings have been defaced, altered, or removed • Consumable components of any type are not covered, including but not limited to fans, fuses and filters etc. • Cosmetic shortcoming which do not impair the use of the product for the intended purpose i.e. supply of energy Warranty claims also exclude: • Damages arising due to the fact that the use of the product for the intended purpose is no longer possible or only possible with restrictions as a result of amendments to the statutory provisions applicable to the operation of the product made after the delivery of the product • Compensation for damages related to loss of power production or business operation or any expenses incurred by customer towards repair & replacement of the product (including but not limited to labor, transportation, temporary power) • Cost arising from changes to existing PV systems or building installations or vehicle or marine vessel installation and like • Additional costs and expenses (i.e. shipping costs, travel, accommodation, meals, etc.) arising due to remote locations of the indicated geographies, including but not limited to islands and overseas territories

The calculation and comparison of the amounts described in clauses (i) and (ii) of the preceding sentence shall be included in all calculations made pursuant to Article IV of this Agreement, and in the event the sum of the amounts described in said clause (i) exceeds the amount described in said clause (ii), then the payments otherwise due from the Applicant to the District under Articles IV, V, and VI shall be reduced until such excess is eliminated.

  • Billing Limitations a. DSHS shall pay the Contractor only for authorized services provided in accordance with this Contract.
