Fresh Food Store Requirements. (a) The Lessee covenants to comply with the following requirements (the “Fresh Food Store Requirements”) during the term of this Agreement: (i) The Lessee shall use at least 5,000 square feet of the portion of the Facility used for retail operations (the “Retail Facility”) for the sale of a general line of food and nonfood grocery products intended for home preparation, consumption and utilization. (ii) The Lessee shall use Retail Facility in accordance with the following requirements: (1) At least 50% of the Retail Facility shall be used for the sale of a general line of food products and non-food grocery products intended for home preparation, consumption and utilization; and (2) At least 30% of the Retail Facility shall be used for the sale of perishable goods that may include dairy, fresh produce, fresh meats, poultry, fish and frozen foods; and (3) At least 500 square feet of the Retail Facility shall be used for the sale of fresh produce. (b) The Lessee shall deliver to the Agency on August 1st of each year, commencing on the August 1st immediately following the Commencement Date, a completed Certificate Certifying that the Facility is in compliance with the Fresh Food Store Requirements in the form of Exhibit N hereto. Fresh Food Store Requirements. (a) The Lessee covenants to comply with the following requirements (the “Fresh Food Store Requirements”) during the term of this Agreement, beginning no later than the Operations Commencement Deadline: (i) The Lessee shall use, or cause the Existing Sublessee or a subsequent Tenant to use, at least 5,000 square feet of the portion of the Facility used for retail operations (the “Retail Facility”) for the sale of a general line of food and nonfood grocery products intended for home preparation, consumption and utilization. (ii) The Lessee shall use, or cause the Existing Sublessee or a subsequent Tenant to use, the Retail Facility in accordance with the following requirements: (1) At least 50% of the Retail Facility shall be used for the sale of a general line of food products intended for home preparation, consumption and utilization; and (2) At least 30% of the Retail Facility shall be used for the sale of perishable goods that may include dairy, fresh produce, fresh meats, poultry, fish and frozen foods; and (3) At least 500 square feet of the Retail Facility shall be used for the sale of fresh produce.   • Health Requirements A. Provider shall remain in compliance with all applicable federal, state, county, and municipal, statutes, laws, ordinances, regulations, and guidelines, as well as any Board guidelines, policies, and rules in effect now or later, and as amended from time to time related to COVID-19. B. Provider shall comply with evolving requirements to protect the health and safety of Student Participants and staff, as expressed in local, and state guidance from various government agencies. This includes, but is not limited to, adhering to all health and safety guidelines issued by CPS, IDPH, and CDPH related to COVID-19. Provider acknowledges these health and safety guidelines are subject to change. C. Required health and safety practices may vary across age groups and settings. Provider shall comply, at a minimum, with all health and safety mandates issued by the State of Illinois and the City of Chicago and guidance from the Illinois State Board of Education (“ISBE”). D. Under Chicago’s March 19 Public Health Order, congregate facilities (such as long-term care facilities, childcare settings, correctional facilities, etc.) must immediately report to CDPH clusters of COVID-19 patients, defined as two or more confirmed cases of COVID-19 occurring within 14 calendar days of each other at a facility. To report positive cases, Provider must complete the COVID-19 Online Case Report Form found at the following website: xxxxx://xxxxxx.xxx.xxxxxxxx.xxx/surveys/?s=FR7MAJAY84. A copy of the current COVID-19 Online Case Report Form is attached and incorporated into this Supplemental Scope as Attachment A. Provider must also comply with additional operational, reporting and tracing requirements established by CPS. E. As of July 13, 2020, interim guidance issued by CDPH encourages notification for every COVID-19 case.   • Software Requirements 7 Developer shall prepare the Project Schedule using Oracle’s Primavera P6.

  • Personnel Requirements a. The CONTRACTOR shall secure, at the CONTRACTOR'S own expense, all personnel required to perform this Contract. b.   • Disclosure Requirements (a) The Estate Agent or Salesperson *has / does not have(1) (11) a conflict or potential conflict of interest in acting for the Tenant.   • ORDERING REQUIREMENTS Eligible Purchasers shall order Goods and/or Services from this Contract, consistent with the terms hereof and by using any ordering mechanism agreeable both to Contractor and Purchaser but including, at a minimum, a purchase order. When practicable, Contractor and Purchaser also shall use telephone orders, email orders, web- based orders, and similar procurement methods (collectively “Purchaser Order”). All Purchase Orders must reference the Contract number. The terms of this Contract shall apply to any Purchase Order and, in the event of any conflict, the terms of this Contract shall prevail. Notwithstanding any provision to the contrary, in no event shall any ‘click-agreement,’ software or web-based application terms and conditions, or any other agreement modify the terms and conditions of this Contract.

  • Operational Requirements 4 At-Sea Monitors are deployed, in accordance with coverage rates developed by 5 NMFS and as assigned through the Pre-Trip Notification System (PTNS), to 6 vessels. Due to availability of funding, changes in the fishery management, 7 such as emergency closures, court ordered closures, weather, and unforeseen 8 events must remain flexible.
