Further review and adjustment a further one-off adjustment in rates of pay may be made if there is an increase in recording and broadcast activity in the two-year period immediately following the inclusion of the RBA into base rates of pay and role classifications are financially disadvantaged. Immediately following certification by the NSW Industrial Relations Commission, the SOH will no longer quote or charge specific recording and broadcast allowance fees to potential hirers. The SOH will continue to document recording and broadcast activity for a two-year period following the inclusion of the RBA into base rates of pay. This is for the sole purpose of determining the RBA earnings that would have applied if the allowance had continued unchanged (2018 review data). These records will be sufficient to facilitate an appropriate review by the parties. The terms and conditions of the Sydney Opera House Enterprise Agreement 2013-2016 that prescribed eligibility for payment of a Recording and Broadcast Allowance will continue to apply for the purpose of this review. If this review finds that the former method for calculating the RBA allowance would have resulted in a higher rate than was included in base rates of pay in 2016, this higher rate will apply to ensure relevant departmental employees were not financially disadvantaged. However, no adjustment to rates of pay will occur if there is no financial detriment.

  • Ongoing Review and Revisions As set forth in Section 35.7, the Parties have agreed to the coordination and exchange of data and information under this Agreement to enhance system reliability and efficient market operations as systems exist and are contemplated as of the Effective Date. The Parties expect that these systems and the technology applicable to these systems and to the collection and exchange of data will change from time to time throughout the term of this Agreement. The Parties agree that the objectives of this Agreement can be fulfilled efficiently and economically only if the Parties, from time to time, review and, as appropriate, revise the requirements stated herein in response to such changes, including deleting, adding, or revising requirements and protocols. Each Party will negotiate in good faith in response to such revisions the other Party may propose from time to time. Nothing in this Agreement, however, shall require any Party to reach agreement with respect to any such changes, or to purchase, install, or otherwise implement new equipment, software, or devices, or functions, except as required to perform this Agreement.

  • Monitoring and Adjusting Forecasts Verizon will, for ninety (90) days, monitor traffic on each trunk group that it establishes at ECI’s suggestion or request pursuant to the procedures identified in Section 14.2 of this Attachment. At the end of such ninety-(90) day period, Verizon may disconnect trunks that, based on reasonable engineering criteria and capacity constraints, are not warranted by the actual traffic volume experienced. If, after such initial ninety (90) day period for a trunk group, Verizon determines that any trunks in the trunk group in excess of two (2) DS1s are not warranted by actual traffic volumes (considering engineering criteria for busy Centium Call Second (Hundred Call Second) and blocking percentages), then Verizon may hold ECI financially responsible for the excess facilities and disconnect such excess facilities.
