RECORDING AND BROADCAST. 19.01 In the event the Employer permits or reproduces an attraction for commercial use in whole or in part covered hereunder using audiotape, videotape, film, broadcast, webcast, streaming (live or otherwise) or any other form of reproduction currently in existence or to be developed in the future, Wardrobe, Make up and Hair work, which is normally within the competence of the Union, shall be handled by the Employees supplied by the Union, and all Employees so employed shall be paid an additional premium of fifty percent (50%) the prevailing hourly rate per hour for the entirety of the call. For the purposes of this provision, an audio or visual recording shall be considered commercial use when there is a direct correlation of such recording and financial gain. For example, if an Artist live-streams a performance whereby the viewers of such live-stream are required to purchase access to the performance, such shall be considered commercial use. The parties acknowledge that any additional compensation for commercial broadcast and/or recording by anyone other than the Employer shall be a subject of negotiations between the Union and the producer of such broadcast and/or recording.
RECORDING AND BROADCAST. 13.01 In the event the Employer reproduces an attraction covered hereunder using audiotape, videotape, film, broadcast, webcast or any other form of reproduction currently in existence or to be developed in the future (hereinafter “Reproduction”), the following provisions shall apply.
