  • STAGE If the is not satisfied with the decision of the Chair or designee or if a decision is not received within the specified time limits, the may apply to the Crown Employees Grievance Settlement Board for a hearing of the grievance within five (5) days of the date received the decision or within five (5) days of the expiration of the specified time limit for receiving a decision. An employee claiming has been dismissed without just cause shall be entitled to file a grievance commencing at STAGE provided does so within ten (10) days of the date of the dismissal. The Union shall have the right to lodge a grievance based on a difference arising directly with the Employer. However, such a grievance shall not include any matter upon which an employee is personally entitled to grieve. Such grievance shall first be presented, in writing, to the Employer within twenty (20) days of the circumstances giving rise to the grievance. A meeting between representatives of the Union and the Employer will be held within ten days of receipt of the grievance. The grievance shall be answered in writing by the Employer within ten days of such meeting, following which or failing settlement of the grievance, the Union may submit the grievance to the Crown Employees Grievance Settlement Board within a further period of ten days. The Employer shall have the right to lodge a grievance as defined above or relating to the conduct of the Union or any officer or representative of the Union or the conduct of the employee. Such grievance shall first be presented, in writing, to the Union within twenty (20) days of the circumstances giving rise to the grievance. A meeting between representatives of the Union and the Employer will be held within ten days of receipt of the grievance. The grievance shall be answered in writing by the Union within ten days of such meeting, following which or failing settlement of the grievance, the Employer may submit the grievance to the Crown Employees Grievance Settlement Board within a further period of ten days. The Crown Employees Grievance Settlement Board shall not be authorized to alter, modify or amend any part of this Agreement nor shall the Crown Employees Grievance Settlement Board give any decision inconsistent with the provisions of this Agreement. The determination of a grievance by the Crown Employees Grievance Settlement Board pursuant to the terms of this Agreement is final and binding upon the parties and the employees covered by this Agreement. At any STAGE of the Grievance Procedure, the time limits imposed upon either party may be extended, in writing, by mutual agreement. As an alternative to the procedures described at STAGE in Article the parties may choose to proceed with final disposition of a grievance by the use of Mediation/ Arbitration. This alternative shall be implemented within the provisions of Appendix of this Agreement and agreed as being in conformity with the provisions of Article of this Agreement. Where a grievance is not processed within the time allowed or has not been processed by the employee or the Union within the time prescribed it shall be deemed to have been withdrawn.

  • Review Stages The Project Architect shall submit documents to the Owner for review at completion of the Schematic Design Phase, Design Development Phase and at the following stages of completion of the Construction Documents Phase as follows: 50%, 75%, 100%

  • Stage Two The State shall not sell or grant any lease or licence over the Stage 2 area before the date or extended date by which proposals must be approved or determined under clause 5(10) so that the Stage 2 area or part of it is available for the expansion of the Project upon such terms and conditions (if any) as may be agreed upon by the parties prior to that date or extended date.

  • Bidding Process 3.1. Bidding shall generally commence based on the sequence of the lot being shown on the PAH Website. However the Auctioneer has the right to vary the sequence without having to give prior notice to the intended bidders.

  • Completion Dates The Recipient agrees to complete each Project within the time periods specified in the Underlying Agreement and all activities must be completed by the Award’s end date, unless FTA agrees in writing to extend the end date. Unless FTA determines otherwise in writing, interim milestone dates and other completion dates applicable to the Award are good faith estimates and are not intended to be firm contractual requirements. However, FTA and the Recipient agree that milestone dates and other completion dates for Full Funding Grant Agreements, Small Starts Grant Agreements or other specific agreements in which FTA expressly states that the milestone dates or other completion dates for the Underlying Agreement are firm dates that may be enforced.

  • Stage One Incident Investigation

  • Complaint Stage It is the mutual desire of the Parties that the complaints of employees shall be adjusted as quickly as possible. An employee who has a complaint must bring that complaint to the attention of the immediate Manager within five (5) working days of when the employee became or ought reasonably to have become aware of the occurrence that gave rise to the complaint. It is understood that no employee has a grievance until the immediate Manager has been given an opportunity to adjust the complaint and verbally reply, which shall be a maximum of three (3) working days from the presentation of the complaint.

  • Phase 2 Phase 2 is expected to consist of Member Nodes and a select number of Nodes operated by non-Members. The non-Member Nodes will be required to comply with Node hosting terms as set forth by the Council, which may be amended from time to time (the “General Node Terms”).

  • Preconstruction Conference Prior to, or concurrent with, the issuance of the Notice to Proceed with Construction, a conference will be convened for attendance by the Owner, Contractor, A/E and appropriate Subcontractors. The purpose of the conference is to establish a working understanding among the parties as to the Work, the operational conditions at the Project Site, and general administration of the Project. Topics include communications, schedules, procedures for handling Shop Drawings and other submittals, processing Applications for Payment, maintaining required records and all other matters of importance to the administration of the Project and effective communications between the project team members.

  • Phases Contractor acknowledges and agrees the Project will progress in phases, in accordance with the Project Schedule. Contractor shall prepare, for Owner Parties’ review and approval, a separate Construction Schedule, for each phase. Each phase shall commence upon Owner Parties’ issuance of a Notice to Proceed for such phase and shall achieve Substantial Completion by the milestone dates set forth in the Contract Documents, including the Construction Schedule.
