Common use of General Personnel Provisions Clause in Contracts

General Personnel Provisions. A. Contractor shall be solely responsible for the satisfactory work performed of all its employees. All Contractor personnel shall maintain a professional, courteous attitude, answering to the best of their ability any passenger questions regarding the provision of service. Discourtesy, rudeness or the use of profanity will not be tolerated and shall be grounds for immediate removal of the offending employee from performing work. B. Contractor shall be responsible for payment, including any benefits, of all employees and subcontractors. C. Contractor shall hold harmless the City of Burbank from any liability, damages, claims, costs, and expenses of any nature arising from alleged violations of personnel practices. D. The City shall be notified of new hires and reassignments of project management personnel and a list of current personnel shall be maintained by contractor. E. Contractor management personnel shall report all passenger complaints and/or any operational problems to the City within 24 hours, or as soon thereafter as possible. F. Contractor shall fully investigate all requests and complaints received by Contractor or City and return the results of the investigation to the City and the complainant within five (5) days of receipt of such request or complaint. Contractor's failure to respond to a complaint or written request on time, unless otherwise agreed to by the City, shall result in a penalty to Contractor of twenty-five dollars ($25) per occurrence. G. Drivers and dispatchers shall accurately complete and submit daily operating reports and any other data requested by the City.
