GENERAL POWER CONTRACT PROVISIONS. The General Power Contract Provisions (GPCP) effective September 1, 2007, attached hereto as Attachment 6, are hereby made a part of this Agreement with the same force and effect as if expressly set forth herein; provided, that if the provisions in the GPCP are in conflict with this Agreement, the terms of this Agreement shall control.
GENERAL POWER CONTRACT PROVISIONS. GENERAL POWER CONTRACT PROVISIONS. Requesting Party or Licensee Designee agrees to Provision Nos. 41-45 of WAPA’s General Power Contract Provisions (GPCPs), attached hereto as Attachment No. 1. References in the GPCPs to “Contractor” shall mean Requesting Party or Licensee Designee.
GENERAL POWER CONTRACT PROVISIONS. The GPCPs effective September 1, 2007, attached hereto, are hereby made a part of this Contract the same as if they had been expressly set forth herein; Provided, That Articles 1.2 and 20 through 30, shall not apply or be incorporated herein; Provided, That Contractor transactions utilizing capacity and/or energy under this Contract with an entity or entities that coordinate, control, monitor, or support operation of the bulk electric system, or act as a marketplace operator of wholesale power, or procure products or service on behalf of any such entity, including but not limited to independent system operators, regional system operators, transmission organizations, balancing authorities, or successor organizations associated with the Contractor’s load shall not be considered a sale for resale.

GENERAL POWER CONTRACT PROVISIONS. (b) This contract shall be subject to all the provisions and conditions of the Act of Congress entitled the Work Hours Act of 1962, approved August 13, 1962 (76 Stat. 357), which establishes standards for hours of work and overtime pay of laborers and mechanics employed on work done under contract for, or with the financial aid of, the United States, the same as if that Act had been specifically set forth herein.
GENERAL POWER CONTRACT PROVISIONS. THE FOLLOWING PROVISIONS ARE APPLICABLE ONLY WHEN THE ELECTRIC SERVICE TO BE FURNISHED ARTICLE PROVIDES THAT SERVICE WILL BE FURNISHED OVER THE FACILITIES OF A THIRD PARTY:

Western’s General Power Contract Provisions (GPCP), effective September 1, 2007, are included hereto, and are hereby made a part of this Agreement the same as if they had been expressly set forth herein; provided, that only provisions 1.1, 2, 31, 35.2 and 38 through 45 shall apply; and further provided, that if these applicable provisions in the GPCP are in conflict with this Agreement and a Confirmation, the terms of this Agreement and the Confirmation shall control. If the terms of this Agreement are in conflict with the terms of the Confirmation, then the terms of the Confirmation shall control.
