Greater Sage-Grouse. The GSG is the largest North American grouse species, weighing between 2 to 6 pounds, and is a wide-ranging species that currently occurs across 11 states and two Canadian provinces. However, the species’ distribution and numbers have shown an overall decreasing trend (Xxxxxxxx et al. 2004). Between 1999 and 2003 the USFWS received eight petitions to list various populations of GSG under the ESA (see xxxxx://xxx.xxx.xxx/species/greater-sage-grouse-centrocercus- urophasianus). On January 12, 2005, the USFWS published a finding that the species did not warrant protection under the ESA (70 CFR 2244-2282). The USFWS’s “not warranted” finding was challenged in court, and in December 2007, a Federal Judge ordered the USFWS to reconsider its decision. The USFWS did reconsider its “not warranted” decision and in March of 2010 (75 Fed. Reg. 13910, March 5, 2010) announced that listing GSG as a threatened species under the ESA was warranted but precluded at that time due to other, higher priority conservation listings. On September 22, 2015, the USFWS determined that the species was not warranted for listing under the ESA (50 CFR Part 17). The population of GSG on the Ranch is part of the Rich County population which (according to limited data and wildlife biologist observations) is contiguous to and part of the regional population of the species in southwestern Wyoming, southeastern Idaho and other populations in Morgan and Summit Counties in Utah. The relationship of the regional population has not yet been fully analyzed or documented. Under the Agreement, should the GSG be listed, DLL will receive incidental take coverage through an ESA Section 10(a)(1)(A) Enhancement of Survival Permit for GSG to be issued by the USFWS.

  • Utilization Scale STATE shall scale logs or portions of logs that are broken, wasted, or not removed by PURCHASER due to: (1) improper felling or bucking of the logs; (2) failure to remove the logs prior to deterioration; and (3) logs remaining on the timber sale area after completion of logging, provided the logs were merchantable prior to breakage or wastage. Material used to meet down material requirements in the section titled, "Reserved Timber," shall not be considered for utilization scale. PURCHASER shall pay for the logs at the contract price designated in Section 44. STATE shall notify PURCHASER of the volume of logs so scaled. Payment shall be considered due on such volume as if the logs were removed on the date of said notification. In the event PURCHASER disagrees with the findings made by STATE under this section, PURCHASER may furnish scaling by a third-party scaling organization acceptable to STATE. Costs and expenses of such third party shall be paid for by PURCHASER, and the findings of the third party shall be final.

  • Reallocation to a Class with a Higher Salary Range Maximum Upon appointment to the higher class, the employee’s base salary will be increased to a step of the range for the new class that is nearest to five percent (5.0%) higher than the amount of the pre-promotional step, or to the entry step of the new range, whichever is higher.
